Actually, what he said was Chapter 7, which is complete liquidation. The westies call it liquidation when they really mean Chapter 11 and they call it bankruptcy when they really mean Chapter 7. Big difference between the two.

Now I know your next question is how much human waste you can send before you can be included in a law suit. I think this depends (no pun intended) on diet and health. Each person is different so it would be hard to put a finger (no pun intended) on this.
 
Maybe they thought that making any telco related crime charges stick might imply trying to convince a jury that a member of a class/craft is not permitted to call his union. None of these would surprise me all that much.


From Paragraph 53:

Okay, let's do the math for just this ONE portion of that ONE charge.

1,810 minutes divided by 60 min/hour = 30.17 hours in 4 to 5 days, or 6 to 7.5 hours per day calling his union, as CluelessByFour states.

Plaintiff's Attorney: "So, Mr. Xxxxx, what did you talk about with USAPA for those 5 days, 6 hours each day, that was so forgettable that no one at USAPA can recall ever speaking to you?"

Only 241 calls within that few days?...You're right. I don't see the problem then, as that had to clearly be only proper union business...No one, no prudent person, and most certainly no jury member, could possibly ever consider that as even the least bit "unusual".

Well that narrows it down to one of the customers on one of the 3800 flights per day. :lol:

I just had a revelation; if they do close one or both of those bases and all those westies get to commute east, how are they going to get to work? I doubt the jumpseat will be available to them; safety of flight you know.

You drive the bus. I'll do what I do. When you have had this happen--like, say, dummy phone calls flooding a telecommunication facility in a manner which crosses state lines and actually have the feds bring criminal action against the perps (in that district, natch), let me know. In the meantime, I'd stick to what you know.



You make two large assumptions:

1. That it gets to a jury.

2. They still manage the contract that these clowns work under, correct?

I don't even think it passes the smell test, personally. I also know that if the feds saw enough to warrant a charge, the odds are heavy that they would have acted already and/or would have told the allegedly aggrieved party to wait until after the criminal complaint was brought, and ideally resolved. Seeham should know this. Think about it.


It's tough to deny one's reason for existence, ne c'est pas?



If they don't have the technical acumen to deal with (judging by what's in the complaint) a relatively small number of calls from repeat numbers (or attract telco/IT providers that do), I'd be scared--since they presumably can't hire good help, and that's going to hurt come time to negotiate with the company. If they "need space," from this, then they are weaker than we all thought and really do only have the tyranny of the majority working for them.

The complaint stated human waste sent via the postal service. A former alpa leader for america west pilots threatening the personal safety of certain america west pilots. Phone harassment that is proven by phone records.

Anyone that condones, belittles or legitimizes this has ignorance that is only exceeded by their arrogance.
 
I was involved in the IAM Negotiations for M&R during the last bankruptcy, was privy to the financial information and the POR, there was never a mention of chapter 7, there was plans for downsizing, not going out of business.

That's apparently, not going to be any problem for them. luvn737's has already covered the west philosophy for any such eventuality = "Word on the street is that the company can't tell you where to live, only that you have to show up on time. How you do that is up to you. No-showing for a flight regardless of the reason will be dealt with much more severely than pointing a finger at someone and saying, "bbbbut, he MADE me late!"
I'd say the best investment in your future would be to look for a home in PHL or CLT. Why put yourself through the stress of worrying about getting to work.
Last I checked, the jumpseat was referred to as a "priviledge" not a right." Add to that the "fact" that PHX/LAS is clearly the center of the universe..and could NEVER possibly close in any case. What other explanation's even possible for all those rosy "career expectations" out there that so brilliantly "justify" Nic? :rolleyes:

"Career expectations" is always good for a hearty laugh in any case. I know, I know = "Everyone" at AWA was "expecting" and "entitled" to be a captain by at least last Christmas...but...ummm....How did just oil futures play into any "expectations"? How does anyone think that 9-11 effected things earlier?/etc. Hmm...perhaps it's time to take another "snapshot"? ;)

Thank you. I've been trying to make that point for years.

When the first bankruptcy was about to go, it seemed like everyone had set their hair on fire and could not understand why I was trying to explain the (sometimes) giant differences between 7 and 11. The last pilot union certainly was responsible for a lot of the "setting hair on fire", not bothering to educate, rather, as if they had signed off on it, actually helping cause more chaos.

Thank god the pilots here finally got their act together and sent a wake-up call.

Everyones expectations industry wide have declined, except for yours. You still have a job. You are welcome..
