What if ALPA had told you they were taking $1600 from you to lose in court. Would you all be willing to just hand over that money without holding someone accountable? Why are you letting usapa take it from you?

$1600 - $16,000 whatever. That seniority award is a non-starter. Period.

Hopefully one day you will grasp this and then we can move towards a contract that will actually pass membership ratification.

What will that contract look like? What will that contract have to have in it?

USAPA is required by federal injunction to use the Nicolau award for all seniority issues. Accept that. There will not be any contract sent to vote without the Nicolau.

Now what does the rest of the contract have to be to pass?

Question: when (if) the pay snapback is denied, how long do you think it will take to sink in that you won't get a raise without ratifying a contract with Nicolau in it?

Yeah, you have folks like Snoopy running around here talking about winning the appeal and the snapback arbitration, but when would now be a good time to start thinking about the overwhelming possibility that you never get another dime without Nicolau?

Denial is a river in Egypt, not running past the USAPA offices in CLT.

If the majority of east pilots think that it is acceptable to allow this leadership to irresponsibly waste union money on legal filings designed for nothing more than delay and to make the lawyers money. To allow, no demand that they file RICO charges against individual pilots. To allow this leadership to threaten to sue the DOL because they are investigating election fraud. To encourage an illegal job action on Jan 1.

Then it is the east pilots that are out of control and irresponsible. It SHOULD be the job of responsible union leadership to tell the members that they are wrong and to lead in the correct direction. Standing in front of a mob demanding things is not leadership. A majority of east pilots are demanding things that no one can get you. Mike Cleary standing out front agreeing with the mob, promising things that he cannot deliver is not leading.

Who will you all blame when the ninth denies the appeal? Who will you blame when the snap back is denied? Who will you blame when you are still living under LOA 93 two or three years from now?

The west pilots?

We are not the majority. We cannot determine any direction at all you have told us that from the beginning. This ride is completely directed by irresponsible east pilots and the guys standing in front of the angry mob. I am encouraged by the statement. “and a couple of eastiesâ€￾ At least someone over there is getting it.

But maybe by next summer when the appeal is done and the pay check still says crap wages maybe “the majorityâ€￾ will turn on the people that got you here. Ops that would mean blaming yourselves for this mess. We all know east pilots never take responsibility for their mistakes it must always be someone else’s fault.

I have had to delete a couple of posts from this thread because they "irked" me.....
they contributed nothing to the discussion but to taunt another member....it appears some of you really need to read the rules at the top of the forum AGAIN.

It would send a clear message if the East's objectors became MIG's and had the ability to vote and then become objectors again if they so chose. The reason is simply that being able to vote is too important a decision to waive at this time.

That is a good message. Many west objectors are becoming migs, putting their distaste aside and using cold, hard logic. I certainly hope some of the east objectors are doing the same.

You need to grasp the concept that ANY contract offered will include the Nicolau Award, by law.

More and more pilots are coming to grips with that reality and will ratify a contract at some point, and it will include the Nic absent a legal miracle forthcoming.

Period.

we are quite pleased with the progress our team is making.

Wow!! From USAPA:

"Fourth, the trial was unfair in several respects, in particular because the jury instructions so badly misstated law that it compelled an unfair verdict and because Judge Wake was biased;"

Wow, USAPA apparently wanted the Kirby deal. At least that is what they are arguably saying to the appeals court.

The impasse, among other things, meant that the pilot group could not obtain company-offered contract improvements, which the carrier insisted were contingent on the execution of a single CBA. ((6ER1175:15-19) (4ER720)). US Airways’ offer would have increased total pilot compensation by over $120 million per year. (4ER720). Instead, the East-West impasse left US Airways pilots at the “bottom of the barrelâ€￾ with respect to the rest of the industry. (6ER1252:21-24).
