Wake didn’t hurt us much at all. Believe it or not, Harper’s deposing ALPA now, looking for that conspiracy and his damages money. Hope he finds it. Then you got the deep pocket, ALPA. And since we weren't the CBA and not talking with ALPA at all, you can DFR them. You filed the DFR within 6-month limit. Now you just have to prove ALPA belongs in it. We still got the Breeger ripeness disconnect. The appeal may lose, but it wont be quick.

Harper is deposing ALPA, but not to find a conspiracy to tie ALPA. The damages trial is against USAPA, remember them, they have already been found liable, question is now, how many dollars liable? Now what would ALPA know that can be used against USAPA? hmmm?
 
Losing? Ummm...the West won dude. And the fun isn't over, either! We've got the encore trial coming in August. Then the LOA 84 smackdown in the Fall. Then the Ninth Circuit upholding the trial court next Winter. Then we sit and watch what happens next. Pull up a seat, but bring your own popcorn!

See...here's the difficulty with that = "(whooo whooo, chuga chuga chuga whooo whooo)" presumes substantial industry changes forthcoming. That's very possible indeed. However; within that assumption..there seems even LESS of any rational basis for the east to vote in a nic-inclusive contract. What am I missing here?

It doesn't matter what you guys do at this time-- that is the point. Nicolau is here. The only little game you have left is playing "stop the clock" for as long as possible. I believe Judge Wake has you (pl) on a very short leash so that game probably won't last much longer. After a few more intentional fumbles by the NC maybe the judge will appoint one for USAPa. Maybe Judge Wake will order the company and USAPa to negotiations until a final product is completed. I don't know and am just speculating because we are in uncharted territory here. ALPA took care of their misdeeds against the Jet America pilots in record time, it appears USAPa is still heading full steam off the cliff so one thing I am certain of is the courts will be interacting again with Cleary. You CANT screw around with a federal judge. You guys have gotten away with it up to now but your kindergarten games are about to end.
It is unfortunate we had to come to this point. Of course, it seems predictable given the character of the AAA pilot group and seeing how things went down in 2000 with United. The UAL pilots were able to just slam the door shut on rescuing you guys, we weren't that fortunate. Oh well. Leonidas won, that is what matters and the west is elated with the proposed remedy. You don't understand the significance of it, which isn't surprising, but the rest of the world does. GAME, SET, MATCH.

No one is going to get anywhere near a 'contract on the table' without a substantial picketing (etc) campaign. Stage an event in any East domicile and see how many takers you get in support of an agreement containing the Nic award.

That'll be your proof.

you may need to have a vote, but we don't and we will not have one for a very long time, all the while complying with our legal obligations which essentially have not changed at all since nic came out. As prechill said " nic is over" and it is for many years. The idea of putting the west in charge of the NAC is interesting because it would still take years to complete negotiations with management, don't you agree? So demand a vote, maybe even use caps lock, but you got to realize how far off that is. right? Prove it!!!! why? for you? we don't need to prove it over here.
 
"No West pilot will ever take an east seat." Well..it's a true pity that's not possible to completely and permanently ensure...but, I ask again = What's your envisioned time frame for that actually ever happening?

PS: Captain Sullenberger nowadays has far better things to do than waste his time with PHX......

The timeframe for when a former West pilot occupies a seat in an east domicile is dependant on the method that brings them there.

1. If east recalls more than it has furloughed, possibly as early as spring?

2. If the company elects to break down some barriers and start making decisions based on the inevitability of the Nic, possibly as early as spring?

3. If we wait for normal contract negotiations and move along in a state of status quo, 18-36 months.


PS: I would think Cpt Sullenberger would have better things to do then come to Pheonix, that is why it surprised me that he showed up at Sandra Day.

The 9th Circuit does not care about Breeger (and is free to ignore it, which they probably will). Once they affirm Wake (no more than 18 months, I'd say), SCOTUS will deny cert in a timely fashion and there you are.

You have nothing. You've had nothing. Should you lose the forthcoming LOA 84 arbitration, you will still have Nicolau and be (Kirby + 10%) x 2 years (at least) poorer.

There is a nice North Park Lounge in Cranberry that sells good beer that the Angry FO's can weep into once reality sets in.
