USAPA would dearly love to 'get on with it' and bring home a contract.
However, AOL, through its threat of MORE LEGAL proceedings, is compelling management to once again revisit the courts, this time in search of a free pass on another lawsuit brought by the WEST.
What planet are you on? USAPA is the party trying to get the company's declaratory action thrown out. They'll be unsuccessful, but nonetheless we'd be well on our way to a resolution in the courts if it weren't for USAPA opposing the company's dec action. The company is asking a simple question that has a simple answer (hint: binding probably means binding).
 
It is not the Nicolau that is preventing us from getting a contract.

It is the east pilots that are preventing us from getting a contract. The whole point of arbitration is to avoid long court battles. Both sides agreed to arbitration. It is the east pilots that fail to accept the deal you made.

If east pilots would live up to their word we would all move forward. Instead you are preventing the entire group from getting a contract because you don't think it is fair and you are trying to impose your sense of fairness on all of us.

If the east will not accept the Nicolau than a court is going to have to force feed it to you.

Because we certainly know that an east pilots word is no good. No deals can or will be made with east pilots because you can not be trusted to keep your word.

East pilots are in charge. How is that working for you so far?
It's working very nice so far, plenty of movement on our side, and that will be picking up even more in the future, LOA 84 rates should be coming in (hopefully I add), Such a pity you chose to follow the idiots of AOL. By the way how is that NIC thing workng for you westies?

I don't see how the court is going to force feed the Nicolau to anyone. The court should say, "You morons have the ability to replace the union that is tying a vote up, so why don't you do it!" Evidently none of us really cares enough about voting on any seniority integration to bother taking control away from Cleary, which is pretty pitiful considering how much west money has been spent financing both sides of the case.


The reform USAPA group thinks the problems are cosmetic. Those that want to regain control of pilot labor know they are endemic. But the vast majority of the pilots are apathetic with a capital PATHETIC.

It was an adolescent temper tantrum by the east because they didn’t get their DOH fantasy that caused the division. Any SLI decision by the arbitrator that didn’t go by DOH would have resulted in the same outcome. Apparently the arbitration board was supposed to abandon ALPA merger policy and the TA to give the east their long-awaited DOH list because they really, really wanted access to the west jobs no matter what amount of policy violations and harm to the west pilots DOH would bring. One cannot evaluate the merits and fairness of the NIC award based on east pilot acceptance. I doubt King Solomon with all of his God-granted wisdom could have arbitrated a list that was mutually acceptable to both the east and the west given the east’s all or nothing mentality. Of course Solomon wouldn’t let the east get away with thumbing their noses at his decision for this long either. The days of swift justice have left us long ago.

All the EAST has to do is live up to your word and we can move on. so simple even an east pilot can understand.

You need a contract to get the NIC and you cant' get a contract with the NIC. So how do we solve this dilemma? It won't matter after May 21st. anyhow.
