What planet are you on? USAPA is the party trying to get the company's declaratory action thrown out. They'll be unsuccessful, but nonetheless we'd be well on our way to a resolution in the courts if it weren't for USAPA opposing the company's dec action. The company is asking a simple question that has a simple answer (hint: binding probably means binding).USAPA would dearly love to 'get on with it' and bring home a contract.
However, AOL, through its threat of MORE LEGAL proceedings, is compelling management to once again revisit the courts, this time in search of a free pass on another lawsuit brought by the WEST.
