My first mistake was thinking there was any logic involved.

So, your premise is to have usapa "accept" the Nic, yet reorder seniority for LCC pilots during a merger integration?


AOL would not bother suing usapa in your fantasy scenario. The named defendants would be usapa, the APA, and the airline parties in existance at the time.

Collusion in an illegal enterprise would be a really bad place for the corporation or the APA to go. I think they are both smart enough to not let the about to disappear scab union hand them the bag.

Would you rather they do to you what they did to the TWA pilots?

You guys love law suits so go ahead and sue the APA - they have way more money than USAPA and AOL. Do you think the company wants to piss off the APA? Do you think the APA will be happy with putting their 6yrs of service pilots (now furloughed) behind the AWA newhires?

And also where did you pick up the spelling of the word answere? Its ANSWER - did you learn how to spell in Australia scab?

Maybe the company will realize they can just shut down PHX and recall the APA furloughed guys to fly your planes - you guys keep threatening to sue the company.

First of all, the new contract and pay rates will be in place immediately upon consummation of the merger, or the merger will not happen. Then the SLI will begin.

The three lists are:

1. American top to bottom including furloughed

2. East including new hires

3. West, including furloughed

APA is going to try and crush us anyway they can! A Nic integration would be much harder for APA to get a favorable SLI than using the three lists separately. The West only has six 757's, all the rest are narrow bodies. The East retires 2000 in the next eight years, a seven year fence will work just fine. The slotted integration that you guys want so bad will take your age and AC into account.

The APA has done an analysis of the three groups and the biggest problem is the West group, because they are so young. You'll get your chance, you just have to wait in line like everyone else.

First off it will be the Nicolau. End of story.

But your theory does not hold up. Go find a copy of the T/A and have someone read it to you. You have hear the term "third listers"? Any idea what that means?

The new hires go below east and west pilots. You can't reorder that. You also have west pilot flying out east. They are senior to east pilots on the Nicolau list. If they are reordered usapa violates the agreement.


A fence is going to be for equipment not bases. You east guys are not going to get to ride out your career protected from the rest of the airline. If you are junior reserve F/O now get used to it. There are a bunch of AA pilots that will move to CLT and PHL. Enjoy.

One last thing. Tell us what do you think that average of a west pilot is? What is the average age of an east pilot? APA is not going to care what our birthdays are.

Point is, we all know usapa is gone. No point or leverage in suing usapa alone. But, they would get named in the suit. Gotta have Bradford etc on the stand.

Not without a ratified contract. It has been 'accepted' but not implemented.
Besides, the pilot group was/is supposed to get a shiny new contract in return for implementing the list, which enables the company to exercise its synergies by mixing crews and aircraft as one fleet.
No contract, no list - whatever it is.

For years, they just can't get it. And it does not have to be Nicolau either. USAPA is not beholden to the Nic. The 9th told them over and over, but they choose to forget. They seem to forget what the 9th told them some years ago. That is the best part and the one that will get them in the end if APA doesn't first,
