I don’t know about you guys but this does not sound to me like the company thinks to highly of Seham and his filings. For a party that says they are neutral they found 3 reasons to oppose USAPA 0 reasons to oppose the west pilots.
It sure does not look to me like usapa has a willing partner in negotiating a DOH list. What will usapa do if the west pilots refuse to negotiate for anything other than Nicolau and the company refuses to negotiate anything other than the Nicolau list? I guess they negotiate with themselves. I wonder how that will turn out.
Remind me again how usapa won in the ninth? The injunction gave the company cover. They could say a court will not let them negotiate. Without the injunction the company is going to say without the protection (immunity from being sued) of the court they cannot negotiate anything but the Nicolau.
So no injunction, nothing to stop usapa from negotiating any contract they can. When are we going to see that vote? No excuses now. It is all on usapa, time to perform boys let’s see what you can do. Let’s see what kind of skill and talent Cleary has put together.
I know it will be the companies fault right. Bad excuse it is the same company and circumstances that ALPA or any other union would have to deal with. What kind of leverage is usapa going to bring. Oh yea that’s right you have red badge backers. Scary!

That I think is my favorite line. This is from a premiere labor lawyer and expert in RLA. The company thinks that they will get sued and lose if they use something other than the Nicolau award. You guys can not say that this lawyer does not know what he is talking about. That he does not understand RLA.
Could it be that it is Seham that has lead you guys down the wrong path? That Seham misunderstood?

That is what happens when you bring the youngest fleet (with orders for more) of aircraft to a merger party. You get to fly the merged company's routes. I know this is not lost on the usapa seniority theft advocates, otherwise they would be offering fleet protection instead of domicile protections.
BTW, largest hub, largest domicile, and home of corporate headquarters, would like to thank you for flying your TA inflated fleet min at industry low wages and work rules. That really helped when fuel was at $140/barrell. Keep up the good work, there may be an extra $100 if you pulled it off again for July.

I truley suspect the east pilot group is starting to question the path they have chosen. [Not at all, in fact I'm more sure of it every day!] For instance, east pilots have to be questioning why the company would need to file its request to the court, [It is odd, but we understand. They just need to be told 2+2=4. It's called CYA!!] when their brilliant lawyer says usapa is free to negotiate seniority "like a crew meal". Or, they have to be questioning, where is that mandate from the 9th, usapa legal promised by the end of last week? [Ah, I think you spoke too soon. It's done! AND NO, what USAPA DID SAY last week was; it "WILL ISSUE WITHIN DAYS". I'd say they nailed it! See below.] Or, could they be asking themselves, if the 9ths opinion gets overturned or vacated, does that mean we go back to judge Wake's injunction, and more importantly, would that not mean the second half of the bifurcated trial would get scheduled? [By a lower court? Yeah right! I think you'll find out soon enough that this ain't gonna happen. But hey, go ahead, keep your dream alive!!!] Many more questions than I have ever seen usapa legal answere or even bother to consider must be going through their thoughts. Potshots back and forth about east and west strategy and so forth are one thing, but this kind of stuff is just stupid.You should probably read this.
