US Pilots Labor Discussion 8/11- STAY ON TOPIC AND OBSERVE THE RULES

I don’t know about you guys but this does not sound to me like the company thinks to highly of Seham and his filings. For a party that says they are neutral they found 3 reasons to oppose USAPA 0 reasons to oppose the west pilots.

It sure does not look to me like usapa has a willing partner in negotiating a DOH list. What will usapa do if the west pilots refuse to negotiate for anything other than Nicolau and the company refuses to negotiate anything other than the Nicolau list? I guess they negotiate with themselves. I wonder how that will turn out.

Remind me again how usapa won in the ninth? The injunction gave the company cover. They could say a court will not let them negotiate. Without the injunction the company is going to say without the protection (immunity from being sued) of the court they cannot negotiate anything but the Nicolau.

So no injunction, nothing to stop usapa from negotiating any contract they can. When are we going to see that vote? No excuses now. It is all on usapa, time to perform boys let’s see what you can do. Let’s see what kind of skill and talent Cleary has put together.

I know it will be the companies fault right. Bad excuse it is the same company and circumstances that ALPA or any other union would have to deal with. What kind of leverage is usapa going to bring. Oh yea that’s right you have red badge backers. Scary!

it is “[t]he uncertainty surrounding the lawfulness under the Railway Labor Act of the entry into a collective bargaining agreement which does not include the Nicolau Award” that has prevented the successful completion of negotiations.

That I think is my favorite line. This is from a premiere labor lawyer and expert in RLA. The company thinks that they will get sued and lose if they use something other than the Nicolau award. You guys can not say that this lawyer does not know what he is talking about. That he does not understand RLA.

Could it be that it is Seham that has lead you guys down the wrong path? That Seham misunderstood?

Could it be thast U is doing some CYA and making the record
so that in future lawsuits it can argue different points to defend
itself. Try to look a little farther than your own nose when you
analyze these things.

Largest hub is least profitable but inflated with TA block hours ?

That is what happens when you bring the youngest fleet (with orders for more) of aircraft to a merger party. You get to fly the merged company's routes. I know this is not lost on the usapa seniority theft advocates, otherwise they would be offering fleet protection instead of domicile protections.

BTW, largest hub, largest domicile, and home of corporate headquarters, would like to thank you for flying your TA inflated fleet min at industry low wages and work rules. That really helped when fuel was at $140/barrell. Keep up the good work, there may be an extra $100 if you pulled it off again for July.

You do know how the West pilots use the triple play money, right?

Yeah......Ye Olde Rathole!

I thought Charlotte was the largest hub, not Phoenix.

612 daily flights out of CLT (including USX)...

From a recent press release:

CHARLOTTE, N.C., Jun 24, 2010 (BUSINESS WIRE) -- US Airways today resumes daily nonstop flights from its largest hub at Charlotte Douglas International Airport to Baton Rouge, La. after a seven-year hiatus. Customers traveling from the Louisiana state capital now have access to more than 120 domestic and international destinations through Charlotte, where US Airways has expanded its service to 612 daily departures.

I truley suspect the east pilot group is starting to question the path they have chosen. [Not at all, in fact I'm more sure of it every day!] For instance, east pilots have to be questioning why the company would need to file its request to the court, [It is odd, but we understand. They just need to be told 2+2=4. It's called CYA!!] when their brilliant lawyer says usapa is free to negotiate seniority "like a crew meal". Or, they have to be questioning, where is that mandate from the 9th, usapa legal promised by the end of last week? [Ah, I think you spoke too soon. It's done! AND NO, what USAPA DID SAY last week was; it "WILL ISSUE WITHIN DAYS". I'd say they nailed it! See below.] Or, could they be asking themselves, if the 9ths opinion gets overturned or vacated, does that mean we go back to judge Wake's injunction, and more importantly, would that not mean the second half of the bifurcated trial would get scheduled? [By a lower court? Yeah right! I think you'll find out soon enough that this ain't gonna happen. But hey, go ahead, keep your dream alive!!!] Many more questions than I have ever seen usapa legal answere or even bother to consider must be going through their thoughts. [Maybe you see it that way, but we see a CLEARY path.....oops sorry,.....clear path!] Sorry, couldn't pass that one up!

I further suspect that certain east posters on this board are starting to feel the abandonment of their position from their fellow pilots who simply are not buying it anymore. [I suspect your wrong. Again!]

On August 7, USAPA posted the following legal update.

"USAPA Legal Update

Yesterday, August 6, 2010, the Addington co-defendants in the Company's declaratory judgment lawsuit before Judge Silver in federal court in Phoenix filed a brief opposing the Association's motion to stay that case (pending resolution of the Addington appeal before the promised petition to the Supreme Court). They then cross-filed their brief with Judge Wake via a Notice of Filing (a device that lets a court know that or what was filed in another court), although he has no jurisdiction over the Association's motion because the Company's lawsuit was assigned to Judge Silver and no transfer has occurred. In essence, the Addington co-defendants ask Judge Silver to allow the Company to continue to sue them. The Company has not yet responded to the Association's motion to stay. The Association has the right to file a reply brief.

Also yesterday, August 6, 2010, the Addington plaintiffs in the case still pending at the Ninth Circuit filed with Judge Wake a motion for relief from judgment. In essence the motion asks judge Wake to overturn the Ninth Circuit's ruling that the complaint is not ripe and the district court is without jurisdiction over it. The Mandate of the Ninth Circuit will issue within days. When it does it will require Judge Wake to dismiss the lawsuit and all pending motions. The Association has the immediate right to ask the Ninth Circuit to enforce its Mandate if that should become necessary.

Pleez let him CLEARDIRECT) go , he may not be caught up on , "THE PAPER CHASE" reruns! MM!

I don't disagree with you on somethings, but I think your anger at your fellow pilots colors your judgment.

There's nothing wrong with my judgment, thou I am angry.

I go to work to make the most money I can in the least amount of time and effort, not to facilitate the East's fantasy of rewriting the seniority list.

You may want to get your moral compass checked.

You should probably read this. Then you would realize what an absurd post you just made:

http://www.ntsb.gov/publictn/2010/AAR1003.pdf
Indeed. I'm a west guy who cringes when he reads such posts, they are just as you said, absurd. Potshots back and forth about east and west strategy and so forth are one thing, but this kind of stuff is just stupid.
