And this is where you guys run into trouble. Do you really think they are going to let you do to them what you tried to do to us?

Swan,

Facts, ever heard of them. I wonder because your post are constantly filled with BS.

Or, maybe you can explain to the forum exactly what the West, tried to do to you. Please do not leave out any embellishment as you explain the west's failure to capitulate to the will of the association that attempted to steal their livelihoods.

Swan and REed speak the truth! AWA pilots have a big problem with UAL pilots. THeir not going to take some Phoenix kid to waltz into their captain seat in LA. Not going to happen. This merger with UAL was inevitable with USAir- you west guys are riding on our coat tials.

The last I knew the average rank-and-file members were only being sued in their capacity as USAPA members, not in their individual capacities. Also, I believe in order for someone to be sued in their personal capacity for their personal assets they individually need to be served a summons and complaint so that they can individually appear before any court in order to defend themselves in that legal action.

Have a few thousand summons been served in the last few days on all the East pilots?

If they were individually served that would be correct but were they, or is this simply a mischaracterization of what is going on in order to get everyone agitated?

Council, did the damages trial start?

Wonder why Parker was so focused on CHANGE OF CONTROL?? Now you know. And it is going to UAL. Who gives a crap about the WEST. GIVE US THE CASH PARKER, or it is in trouble. Talk about the lottery ticket.

Parker already told you any deal would be structured to not trigger change of control. The real question to ask is does the united pilots contract have change of control language?

Normally a resignation of one of the carriers management is eminent with this type of buy on rumor sell on news information.

Some of the management have a better deal to leave before a transaction. Gangwal left before USAirways changed direction.

Have you heard from Kirby lately?

"Had Gangwal resigned a month earlier, he would have been eligible for a change-in-control severance package related to the failed United merger that would have tripled his salary and bonuses from the past three years and accelerated his retirement benefits, making him eligible for a payout totaling roughly $21 million.

THeir not going to take some Phoenix kid to waltz into their captain seat in LA. Not going to happen. .

Nor will they let the east children, no matter how bad your foolish temper tantrum becomes. Similar to how the West pilots rebutted you.

I was just watching NBC news and they were speculating that Doug Parker would be the head of the combined company. And yes, you're correct about them tip toeing around the "change in control" language.

Now the f/a's are all AFA but I would speculate ALPA would be voted back on the property. So how could NIC be implemented when ALPA just changed merger policy back to DOH?
( I just heard that too, so feel free to correct me)

Had a United Airbus Captain on the jumpseat last month. 19 years and he's 4 from the bottom in JFK.
I can't wait for the west opportunists to spin up their little machine that spews the rancid logic about how nobody is worth anything working for a carrier like US or now UAL. How are you guys going to justify trying to take this guys' career?

It would be "counsel" if you were trying to be sarcastic, but that would never occur.

The damages "trial" isn't a full blown trial since it is part of an ongoing court case. The word you are looking for is bifurcated. The trial started last April and liability for the defendant has already been decided.

Once the case resumes after the ruling from the 9th it will resume, as in start from the point where it left off. All that is left to do is decide the damages.

No would you be so kind as to answer the question, specifically how many of those thousands of summons and complaints have been served recently?

This is what the euphoria before the realty crash smells like. I've seen it many times before with the USAPIANS.
Yes, from the one that has no skin in the game, but can't stay out of the fight. Probably DAL or UAL. Ether way, it is a real problem for your all consuming cause.

Of course I am not trying to be sarcastic.

How could you issue summons, before a damages trial started council? Inform the masses with your wisdom please sir.

The damages trial that did not start yet, has been stayed by Judge Wake, is this not correct sir?

Another seeker of "justice" The kind of justice that puts an active 17 yr. no furloughed guy behind a new hire. That, is a just cause when you too have no skin in the game.

Follow me here. It isn't a damages trial. It is a damages phase of an ** existing ** trial. There will be no more determining if a defendant is ** liable ** for damages, only the amount of the damages.

Go back and read the court records. It is a bifurcated trial.
