That is bad leadership. Almost like a union suing your own pilots for, even if all allegations are true, what amount to high school pranks. There is no reason on Earth why this lawsuit should have ever been filed, much less continue to be prosecuted. This Cactus 18 lawsuit just smacks of union misdirection for its failed policies. No logical person would spend a dime of dues money on this stinker of a case that, even if they win completely would result in minimal monetary damages and would split their pilot group even more. What are these USAPA guys thinking? How can the union membership allow this lunacy to continue?

Why won't you quit beating your wife? Come on, we know you did it, after all it's in the lawsuit we trumped up and filed. Yeah it got thrown out and we're dragging it out on appeal, but just admit you did it and let's move on. How bout it? Why won't you settle?

They most likely would settle on reasonable terms, usapa has not offered any.

I cannot speak for them, but some of these defendants will have usapa over a barrel, if I were them I would be asking for at minimum, a letter of apology, admission of fault, reimbursement of legal fees and the right to persue a countersuit in the future if for any reason my employment and/or advancement is negatively impacted by any usapa member, officer or other affiliate.
 
I think the Federal Court and the Jury of 9 beg to differ on that one.
The same Federal Court that got involved in INTERNAL UNION AFFAIRS. Awfully quiet on the Western Front. Those law clerks going through all the documents are getting a real education about what went down in the Desert Judges' chambers.

Why isn't usapa willing to drop this loser of a case. They could withdraw from the case on their own. usapa does not need anything from the defendants to do that.

This is all about saving face for the union now. They went out on a limb with a made up law suit hoping to get a quick settlement. Now they have a legal and a political problem.

One of the defendants told me that even before they were served Seham was calling looking for a settlement. After it was dismissed usapa wanted to settle for admission of guilt and $10 or no money. Now they want to settle just for an admission they did something.

Ask yourself why is it that it is always usapa that wants to settle not the defendants? usapa might have all of the money but the defendants have the law on their side. At this point they have spent a ton of money and will win the appeal. What is the incentive to settle now?

Any idea how much usapa has spent just on this law suit? What has been the return to the pilots for all of that dues money?

For the same reason no world leader with a brain in his head would negotiate with terrorists. When organizations are founded upon unscrupulous, immoral ideologies that seek the total annihilation of their enemy and lie with unconscionable proclivity, then any negotiations or agreements will be wholly one-sided. The unscrupulous organization will never honor their agreement but will fully expect the other side to honor theirs. Negotiating with such is utterly futile and will leave the honorable party in a condition far worse than if they had not negotiated at all. You attack and destroy terrorists; you do not negotiate with them.

USAPA can never be trusted to keep their word because they were founded upon the principle that binding agreements are meaningless if they aren’t to your liking. Like a terrorist organization, USAPA should never be trusted in negotiations – especially for their arch enemies the west pilots. Therefore, like a terrorist organization, USAPA must be utterly defeated with no thought given to compromise lest USAPA twist and distort every possible piece of yielded ground to the west’s detriment. The Cactus 18 should never admit to the fallacious, baseless charges, but should rather use every judicial means available to extract as much money from the corrupt organization as possible before it implodes.

You keep ignoring the difficult questions.

If a DFR is an internal union matter how are there federal DFR cases to cite? Rakestraw, Ramey, truck drivers, ect.

Do you consider the transition agreement to be a contract?

Clear, we are on to your scheme to get the deadbeat dues payers on the rolls. It is all about trying to get the EVP position up and funded, and another draw on the USAPA cash. Remember, when the 9th whacks Addington out of the park, we are going to get a dues reduction.

I think usapa has about 5 defendants phone numbers tied to "jamming organizational phone lines", some making as few as 7 calls in a 3 day period. Other than that, your other accusations amount to slander and defamation of the other 19 defendants.

In short, usapa has nothing on most of these people, but they are going to have a history of a hostile union, documented in multiple federal courts, seeking intentional harm toward West pilots, when they sue usapa out of existance, if there is even a usapa left after they lose at the 9th and/or the damages trial.
