When you say isn't there something that could make it better than the Nicolau. What? Judge Silverasked that question about something in the contract. Would you be willing to accept a b scale? Give the west more than the east? No, a union can't have different benefits for different members. Plus we now have a contract.

So what could the east (minority) now offer the west to back something other than the Nicolau equal or better than the Nicolau?

Unions provide different benefits for different members all the time.

There is nothing to negotiate now, but we NEVER tried before. A lawsuit got in the way and we never did. Are you saying that it was impossible to come up with a new contract that included a new SL that was better than what we have been through the last 6 years? Not a high standard. The company saw how well your suit worked in saving them money and ran with it instead of doing what they were supposed to do-Negotiate.

That west pilot hired in 1998 is a captain. That east pilot hired in 86 is an F/ O.

I'm an '86 hire and am an A320 captain. Reserve in CLT, could be block holder in DCA. Those beside me on the Nicolau award out in PHX cannot hold captain. Those sitting beside the bottom East 737/A320 on the Nicolau are very junior west F/Os.

So I return to my original point. According to the in the ninth anything that usapa proposed would have to be equal to or better for the west pilots compared to the Nicolau. There is not way to balance that with contract provisions. So what is usapa goi g to propose that does network the fear the west has other than the Nicolau? DOH does not work. Los does not work. Locking PHX in a single base does not work.

What is your proposal?

It's really not worth wasting any more time with someone who can't even hold a civilized conversation.

And for the record, I've already made peace with our situation. Our collective bully mentality (of which I am embarrassed to be associated with) that caused our merger committee to be neutered with an all or nothing plan in the first arbitration, and resulted in years of lost wages, benefits, and quality of life, is the very reason we go into this merger in a weak position. Had we given up the unattainable stance, and proffered a more reasonable position, yeah we may have taken a slight hit, but made it up tenfold with a decent contract. Many tens of thousands of wasted dollars. Millions in legal fees. Hell, just a simple W2 argument going into this next arbitration would have given us a huge leg up with the APA. But it's all water under the bridge now. I'm fine with it. You'll excuse me though if I am not willing to be held hostage any longer by people blinded by their own bitterness and anger. This road is coming to an end soon one way or another, and you attacking everyone won't change the outcome one bit.

The NAC was negotiating with a company that knew they didn't have to do anything, thus keeping their costs low.

My proposal doesn't matter. The fact is the company never tried. With out trying, you don't know what could or couldn't be done.

You really can't read the mind of the 9th circuit judges, can you?

Then see that you don't, I know I won't be. I have enough confidence in my reading comprehension to draw my own conclusions from the language contained in the MOU, as apparently you do also. I look forward to the process moving forward in the next several months, after which, we can compare the accuracy of our differing "understandings" of the same document/agreement.

It will be interesting to see the movement in PHX on the next equipment bid out there, now that the former AWA "one size pay rate fits all" is gone. I would imagine that the deck chairs on the HMS Phxtanic will get quite a "rearrangement", talk about increased training costs! Should be an excellent example of the importance of that nasty old DOH thing, "relatively" junior 75 drivers are going to just love the pay cut, when they get bounced by more "senior" 320 drivers! Welcome to the real world.

I don't place US among the following history-making and visionary airlines by any means, but it's now joining such as Eastern, TWA and even Pan Am, which long set the highest possible benchmark for what a truly great airline was all about. Care to flourish some of your infantile pom poms for the demise of those airlines as well?...Or are you just selective while employing your curious little brand of adolescent stupidity?
