It's only a 2 week or so course right?!    Should be no problem claiming A330,   as I bet they will be looking back to the seats they are "owed"  and trying to lump that into the classification of Wide Bodies they brought to the table
 
Its a tough choice for them if they get a merger committee... All merger committees will have to willing (by binding contractual agreement) accept the terms of the arbitration as provided for in the Protocol Agreement.... status quo of three lists... Soooooo, arguments about why the status quo is incorrect because of the Nic (or anything else)  are necessarily excluded.  A West Merger Committee might not like that entrance fee.  
 
Frankly though they have not shown any concern for jeopardizing their own legal defense by shooting themselves in the foot.... Let's not forget they voted 98% to nullify the 2005 TA, then argued in court that USAPA was guilty for not following the 2005 TA.  
 
I think they could easily agree to the three list status quo just to get a seat to argue against what they agreed to, again.... ya know, integrity matters, and other cheep slogans.
 
Wye River was the point of no return.. and in their haste they departed without a paddle, life raft, life preservers, or an ELT.

To those interested in getting dues returned from the decertified union, Kristen Day is leading the investigation.

  • USAPA ceased being the collective bargaining agent on 9/16/2014, and thus has ceased collecting dues.
  • USAPA's constitution weakly allows for a brief time to conclude existing litigation and current business, BUT must proceed to close its doors.
  • USAPA can not be allowed to spend the $13,000,000.00+ on NEW litigation & ventures.
  • USAPA may run as a non-profit organization, BUT it can not do so with the dues collected from the membership. Those funds MUST be returned per the constitution.

Constant e-mails to the DOL-OLMS and to your own elected officials (your elected representatives for the Committee on Heath, Education, Labor & Pensions can be found here: https://www.govtrack.us/congress/committees/SSHR ) that are involved in labor will be quite enough to get the DOL-OLMS offices to investigate USAPA.

But can the funds be used for present litigation? I as well would like to have my share returned, but it there is outstanding litigation, I expect they will be able to retain a certain amount, if not all of it.

If Leonidas dropped the lawsuits, I think they would find another reason to hang around and spend those funds.

The government may investigate but they are not on your payroll and will not provide a biased, assumptive conclusion.

When you have a legal battle, you go to battle with the laws you have, not the laws you assume you should have.

Leonidas will drop their lawsuits if the West participates with an independent West Merger Committee.  

Oh wait what am i saying Leonidas never shyes away from a frivolous lawsuit.
