US Pilots Labor Discussion 3/1- STAY ON TOPIC AND OBSERVE THE RULES

Seriously, why does the guy have to have some ulterior motive for retiring - he lives in the SFO area and probably has enough money to call it a career so why keep commuting to PHX or the east coast if you don't have to?

Sully and Jeff did a great job. They both represented themselves and our profession well. There is something to be said for going out on top. Can't get much higher than this. It's a good time.

This is a classic! Looks like Ted is realizing that we in the east will never vote to give the west a windfall. While I empathize for those adversely affected by the nic award............that's a beauty!

Some of Ted's quotes below!

Campaign Closing Message to East and West Pilots

While I empathize for those adversely affected by the nic award, we need to recognize the dilemma we find ourselves in and move forward.

Now is the time to assess our situation. Now is the time to move forward. Is our union leadership with us? Are they willing to do what is mutually best for us, not what is most popular?

I write this closing statement not because I’m interested in running for any position, but because it’s time we take another look in the mirror and ask ourselves, “How many more years do we want to let our careers be held hostage to a court room; how many more years do we want to lock ourselves in the past?â€￾ We cannot rewrite the past, only the future.

THE WAR AGAINST USAPA

Although the election is far from over, there are plans in place to destroy USAPA should they prevail as our bargaining agent. We’ve already announced the formation of the America West Airlines Pilots Protective Association (AWAPPA), and the website is up and running at www.awappa.org. In addition, you should have started receiving email communications from AWAPPA that detail, in part, the plans to ensure USAPA fails in its quest to disadvantage America West pilots. If you have not received these emails, please adjust your spam settings to allow emails from [email protected] and/or send an email to that address.

The plan entails a comprehensive legal strategy to be executed by Bredhoff and Kaiser PLLC (the same firm that represented us during the merger), as well as a political strategy to be executed by all 1,800 of us.

I'm a bit curious what this document would have done to negate USAPA's DFR charge? Pointing fingers and saying 'Well he did that!!' has never been an effective defense and, with most of us, fell from favor after graduating the 6th grade. Not to mention that AWAPPA wasn't a BA for an entire pilot group, was never charged with representing the interests of East pilots and therefore it's actions had no bearing on USAPA's responsibilities. Just because someone's out to get you doesn't mean you no longer have the responsibility of doing your job. Since I don't know I can't speak for certain, but it seems like valid reasons to disallow this document to me.

But on a side note, at least AWAPPA was honest about it's intent from the get go.

And I'm not quite sure what your point was about the Tim person in the post above this one... unless you're bashing him for attempting to bury the hatchet. It read like a well thought out plea to the better nature of those affected.

You're funny, Hate. Looks to me like Ted (whoever he is), in his campaign closing message (although he says he's not running for office) is saying that the union should move forward and not try to "rewrite the past" just because it's the "most popular". Yet you can find a few words adjacent to each other and read something different...

The massive 8.8 earthquake that struck Chile may have changed the entire Earth's rotation and shortened the length of days on our planet, a NASA scientist said Monday.

In a related story, US Airways says they will be reducing duty claim payments based on the new “day length,â€￾ which is now shorter by a few billionth of seconds. The company also intends to now only pay $24/day per diem, saying the actual required reduction will “work itself outâ€￾ during the grievance process.

Finally, FAA Administrator Randy Babbitt says that due to the newly shortened day, he now considers all fatigue and crew rest issues resolved.

I get it.

It's okay to have your former MEC Chairman file a law suit against the west, form usapa and openly state 'it's a slam dunk' to avoid the Nic, after usapa is formed 1 st order of business is to file a slap suit against the west and then aggressively go after pilots with the intent of firing them for non-payment of dues.

Now if the West pilots try to defend themselves it's wrong and we should ridicule them for it.

I bow to your superior being.

What the Hell did you expect to happen? You guys were warned from Day 1 that you'd be sued into oblivion and that you'd live with LOA 93 in perpetuity if you tried this USAPA B.S..

What don't you get?

Warned is probably the incorrect word. More like counselled or advised would be more appropriate, as every single source of opinion had told Bradford why the plan would not work. Undaunted, and with Seeham advocating he try, usapa was formed in spite of all the overwhelming wisdom on the subject saying it will not work, and you are opening up yourselves to retaliatory suits, which most likely would succeed.

That is why I am starting to believe that the ulterior goal in the bad faith acts, of simply delaying, will also soon come to an end. Once the 9th rules, if they uphold Wake, either the membership will force a forward moving outcome, or the injunction will be changed toward an immediate implementation, wherein relief from the TA is granted to the company by the courts.

The final nail in usapa's coffin will be hammered by the Cactus 18, once the 4th circuit tosses usapa's appeal.

Trying to force a contract onto 3 parties without their consent or a democratic vote will be an epic legal rat's nest.

Judges compel the unwilling. That's how it works when you are on the losing side of a lawsuit. Wake can impose the nic if he wants to. For now, I think he's just observing USAPA'S behavior as a guide to how to move fwd when the 9th upholds. He does not have to impose an entire contract to remedy the injustice the west has been forced to endure.
