Again with the lottery statements.....oh well....I will have to reinterate my prior post.

A combined seniority list, reached by arbitration, in which I lost seniority and you gained seniority is hardly a lottery win on my part. In fact, I believe your situation more closely resembles a lottery win, undoubtably so, if you were furloughed prior to the merger.

All provisions of ALPA merger policy were followed in this award. Including avoid a windfall to one group at the expense of the other.

THis just in... The 9th circuit court of appeals rejected Seham's claim (no surprise). The desperation level out east is climbing like a V2 rocket. We're going to court baby!!!

Would you be willing to consider the possibility that BB's loyalty is to those pilots who are embarassed at the direction that a radical faction has taken them?

You paint a pretty broad stroke when you equate support for USAPA with loyalty to former co-workers. It would not surprise me to find a growing percentage of east pilots who feel betrayed by those who capitalized on the weakness of ALPA, but were unable to deliver on their promises.

About comments alluding to "angry FOs". The vast majority of all east pilots (not just FOs) stayed during the lean years simply because they believed in DOH/LOS for determining seniority.

I think this nicely summarizes the mentality of the east pilot group. It sounds like what you're saying is "we stuck around because sooner or later there'd be a merger and we'd cash in our longevity." Can you understand why the mere mention of merger with USAir made the blood of other industry pilots run cold? Why the United pilots fought so hard three times to defeat UA/US combinations before they ever got off the ground?
 
All need to read the order denying the "emergency stay". It's pretty brutal on poor old Lee. Kinda makes him look like an idiot. My favorite part is the ending where it states that "Unquestionably" USAPA is relentless in it's opposition to go to trial.

This trial is going to start on the 28th. Period. Kicking, Screaming, and Crying hasn't been nearly as effective a tool on the court system as it was on Spineless "Traitor Prater"
 
To be honest I never thought it had much of a chance. Although a party may appeal from a Rule 23 class certification, the rule specifies that the cause of action is not stayed unless the district court or appeals court so makes such an order. It would have been unusual, even for this case, to have been granted an interlocutory appeal.

You never answered my question before. Are you the east F/O that hated working for US so much that you wanted to go anywhere and ended up at AWA only to be furloughed?

I didn't stay at US because I thought I would get DOH sometime. I stayed because I didn't have a better offer.

Never did I mention merger. I was trying to explain why someone might not give up twenty years of seniority for zero. Unless a company liquidates, the time one spends at a company should be worth something?

I suspect you are, perhaps without knowing it, being somewhat dishonest with yourself. Say, after you have twenty years with a company, would you jump ship at the slightest sign of trouble? What would be your merger stance if, after twenty years, you merged with a two year old company, DOH or slotting? Rhetorically, what was your thought when you heard HP might merge with ATA?

Okay, I just find a copy of the document regarding Hemenway's deposition and now I have to read another? So I try to find.

I go to the ninth circuit court of appeals web site which is ...ca9.uscourts... and notice it is an anagram for..." our cactus 9 "... strange I thought.

So I spell it out entirely.......ca nine dot uscourts dot gov.....and find a perfect anagram of......"our odds not given to cactus"

How Rod Serling is that?

For you east pilots too young to remember Rod Serling was screenwriter and the host of a TV show called "The Twilight Zone" and it was in black and white, cause that was all we had!
