The Addington has not followed the time line of a typical federal civil case. I'm glad of that.

Regardless of the involuntary thin, cynical smile and gentle head shaking in bemused wonderment at the overtly demonstrated "innocence" this produced; I must admit that anyone who can place both "ALPA" and "union" together in any way, shape or form, (much less "run by Adults) should be appreciated for possessing such a remarkably creative imagination. 🙄

While the "ring" issue's quite comical; It's mildly interesting to note that the evidently "appropriate" thing to do, by alpa supporter standards, would be to take whatever monies and efforts went into producing even a fantasized ring...and just give the ring to alpa...for no gain whatsoever to those who worked for and produced it...Just like old times!!

Wow! DOH is really that crazy?..Umm...Then why do you folks out west have a DOH list that's exclusively used for all your bidding/furloughs/etc out west? Troubles in the Desert......

Today, February 12, 2010, Judge Wake reversed his earlier order by issuing a ruling that stays all proceedings in the District Court in the Addington matter until the Ninth Circuit Court of Appeals rules on USAPA's pending appeal from last year's trial, or until further order of the court.

The ruling comes after a hearing held this week in Phoenix on Tuesday, February 9. USAPA’s attorneys then argued for a stay to allow the Ninth Circuit to rule. The plaintiffs continued to oppose a stay of any length of time. In that hearing, Judge Wake commented that “if the Court of Appeals rules that there was no ripe case and vacates my merits judgment ... there wouldn’t have been any point to make these other determinations.â€￾

In today's ruling Judge Wake said:

“[T]he Court concludes that it is likely that a decision on appeal will be made expeditiously and that the net balance of fairness and economy to all parties favors a stay of the pending motions (plaintiff’s motion for attorney fees and USAPA’s motion to dismiss) and of the case until then."

Today's ruling also vacated the court's earlier order setting a hearing to argue pending motions by both sides on February 24.

Troubles? Has the 9th stayed the injunction?

Nope.

Neither has Judge Wake. Doesn't it make sense that if the 9th saw "trouble" that they'd grant USAPA's motion to stay the District Court's comprehensive injunction?

I know I know...that's logical and when we talk to the hard core East, logic doesn't enter into the equation.

The Association sought an expedited appeal last fall, and the Court of Appeals granted it. An expedited briefing and argument schedule was set. The Association also then sought a stay of the case with the District Court. Judge Wake, however, denied that, and the Association then moved for a stay with the Ninth Circuit, which took the motion under advisement. Judge Wake's ruling today reversed his earlier denial of a stay. A copy of today’s order can be found in the Legal Library on the Web site.
