19.602 Status of Representation Certifications
Existing certifications remain in effect until the NMB issues a new certification or dismissal.


19.2 Authority
Pursuant to Section 2, Ninth, the NMB, upon an Application, has the authority to resolve representation disputes arising from a merger involving a Carrier or Carriers covered by the RLA. The NMB will consider these representation issues on a case-by-case basis.

19.1 Merger
Merger is a consolidation, merger, purchase, lease, operating contract, acquisition of control, or similar transaction of two or more business entities.

19.6 Procedure After Finding Single Transportation System
If the NMB determines that a single transportation system exists, the investigation will proceed to address the representation of the proper craft or class. (See Manual Section 19.401.) The bar rules in NMB Rules §1206.4 (29 CFR § 1206.4) do not apply to applications filed under this section. 19.601 Showing of Interest on the Single Transportation System Incumbent organizations have thirty (30) calendar days from the date of the NMB’s single transportation system determination to file an application supported by at least a thirty-five (35) percent showing of interest or to supplement the showing of interest.

Yes, you are correct..!! I was blind in believing what the IAM told the membership. You and 700’s argument revolve around “Official IAM Statements,†That’s not what was conveyed to the membership on the floor…you both know what I’m talking about.

The facts remain:

I lost my 23-year pension under IAM leadership

I lost 23% of my pay under IAM leadership

I lost weeks of vacation under IAM leadership

I lost work, which will NEVER be brought back into house under IAM leadership.

You might want to look at it as what you got to keep not what you think you lost. It wasn't lost it was taken by the courts and the bankrupt company.
We did manage to keep some heavy maintenance work.
We did manage to keep many jobs, yours included.
We will still be getting some slight increases.
And who knows what jobs may or may not come back in-house.

It just amazes me that during the different votes that so may "no" voters would have sooner seen the company go under instead of taking some cuts and surviving until better times.

You may not be the big loser you think you are after all.

Question 1: What contract will you work under? A contract negotiated by the Machinists, Teamsters or an amalgamated agreement (one bargained from both the Machinists and Teamsters agreements)?

Answer 1: There are a few possibilities.

If there is no election and the Machinists Union is certified as your representative, you will work under the bankruptcy-bargained Machinists agreement.

If there is an election and the Machinists is certified as your representative, you will still work under the bankruptcy-bargained Machinists agreement.

If there is an election and the Teamsters Union is certified as your representative, you will work under the bankruptcy-bargained Machinists agreement only until such time as the Teamsters Union concludes bargaining a new agreement that seeks to improve on both the Machinists and Teamsters agreements.

contracts can only be opened by mutual agreement of both parties.....your contract is still out in la-la land...regardless of what peanuts doug threw out...theres no monetary incentive to reopen the contracts,no profits to justify wage and benefits changes.....get a grip.

besides...700 and myself don't have to run home to mommy for advice between posts due to the excellent training supplied by IAM at Placid Harbor.
