The shame here is that there is NO "Standard Operating Procedure or Practice" or even more to the point is there is NO legitimate union practice that any labor organization can sink its teeth into.

Dave and AOL hate USAPA, Dave and the other two PHX BPR reps solely for the purpose of AOL. Talk about conflict of interest.

This sore of pilot conflict is going to take away just about all pilot authority and labor unity is out the door. In fact, safety concerns should mandate that labor unions for pilots are illegal, and further all pilots who have an ATP, type rating and first class medicals should all be paid the same. Furloughs should be based on the pilots who make the most money being the first out the door.

That's what AOL and Dave is all about.

I am about both representing all US Airways pilots and most specifically my PHX based pilots. I have made no secret of my stand on USAPA's failed attempt to secure DOH at the detriment of my PHX based pilots. USAPA was formed primarily for the purpose of evading the Nicolau seniority list (Bradford Letter). A collective bargaining agent can not pick and choose which parts of contracts, letters of agreement, and arbitrations they wish to adhere to.

I don't hate USAPA. I hate the actions of past leaders & the USAPA faithful as they attempted to "break" the West pilot class with various persecutions & litigations.

So how do you feel about the MOU? You voted to send it our to your pilots with a "Yes" recommendation, right? But you are a party to AOL that says it is illegal. What's up with that?

No way we can understand that, even if its explained to us.. Its an integrity matters thingy.

You were asked to stop, even your lawyers were asked to tell you to stop. They stupidly did not. Too bad it took a sledgehammer to kill a gnat. Based on the last few years, I wish we had pursued it in State Court. I have seen the RICO ruling, not quite up to snuff for RICO indeed…but the crimes were there and acknowledged by the court. Don’t think you can sweep that under the rug. [/font][/font]

You are a PHX rep for USAPA and listed as being in the "inner circle" of AOL at cactuspilot.com.

How do you reconcile these statements?

From the 2/19 cactus pilot update:

2/19

"Negotiations addressing the contingencies that can affect seniority are complete. Retrospective pay began February 8th, and the rest of the MOU provisions will be imposed on all parties as we work toward a JCBA with APA.

The MOU was written to be neutral on the Nicolau Award."

And this from your lawsuit:

"The MOU fails to provide that pilot seniority will be

implemented using the Nicolau Award list.



Based on the forgoing, adopting the MOU is a breach of the

Transition Agreement implied covenant."

Yet you sent it out with a "Yes" recommendation and your attorneys told you guys to vote for it.

I know, and I didn't get the tshirt. I just wanted to try again. I figured a guy that could juggle being a USAPA rep and an AOL mover and shaker could explain it to me.

[font=Arial']I read that bizzaro crap this weekend. Apparently Marty and the gang secretly taped the NAC base meetings, and have evidence that the PHX base was told lies. But somehow they chose to vote FOR the MOU by 97%, even knowing the supposed "trick."[/font]

[font=Arial']Give me a break. You cannot "know" something, vote FOR it, and then claim innocence.[/font]

[font=Arial']The postings alone on this forum will be proof enough they were playing games. Silly games that cost them even the chance of ever suing gain over the NIC. Thank goodness for the stupidity of Harper and AOL.[/font]

That is just stupid. I guess you never did get around to reading that Gill award info., did you.

You're right, this is stupid, we're never going to agree on what's fair.

That's why it we sent it to neutral, highly respected, professionally trained third party to decide.
