When was the west going to upgrade in DCA,PHL or CLT had we shut the doors? We didn't, so why does that make a difference. You are a stock trader so what do you think AWA's prospects were? Why did Parker do this merger if not for AWA's benefit?
FWIW, M/B doesn't have "failed carrier doctrine" in the statute.
 
What are you talking about? Don't you understand ripeness? After all that money and all those lessons do you not understand ripeness? For now, paddle whatever direction you want, it's a free country, and lawyers need to eat too. :lol:

Now you want to talk about ripeness instead of what the conversation was about.

Read the complaint again. It is ripe. Simple question. Does the MOU require the Nicolau like the T/A does? No then usapa failed in its duty.

Lets see what direction you east pilot will paddle in when the APA is in charge. Will you follow along with the majority and allow them to decide what seniority should be?

Both companies benefited from the merger. You guys choice to ignore that because your upward progression slowed at the same time. Things is, it's obvious that it would have slowed and Parker says it would have been much worse slowing without the merger. But you guys ignore that because to accept it would show how screwed up the Nicolau award is.

Absent the merger give me the date that you would have upgrade in CLT or flown an A330 out of PHL.

Do you and your attorneys have any personal responsibility for voting yes for the MOU when the language was in there?

I've been told that west pilots had input on the MOU. Were they being deceptive? Noooo..........

Just another fact. Politics are just like the movie "A Few Good Men". (Not particularly one of my favorites but it gets the point across).

The "minority" can't handle the truth. The Colonel was pointing out what is really needed when the "dogs of war" are unleashed, and the preparations needed when at peace. Look at our military now. Women and men come home in "body bags", a flag and a condolence letter while a "buck private" gets a theater medal for flying a drone from Las Vegas.

H3LL, and I served in the military a whole 9 days with an Honorable discharge. I've never thought I should be commander of a squadron because of that.

Yet here we have the same problem...get your ATP and be a "Captain" at an 121 airline. No muss, no fuss. Better yet, log X-box time and you too can have in your care the lives of 150 passengers. No worries.

Our military still carries the stigma of Nam. So does the pilot profession....the stigma of DIKK swinging.

What were you trying to imply. If we are all qualified what is your problem?
If we can all do the same job, and time/experience has no meaning then why should you have preferential treatment over the new hire? Why should the company pay me more than you? Why should I fly the 330 and you fly the 319?

You still don't understand the concept of ripeness... No one yet knows what the majority will support so deciding now what direction you will paddle is hypothetical and premature, but lawyers need to eat too so knock yourself out!

Closing, but glad to see you take Parker's word. Remember when he told the west F/O that was so mad and about to cry that absent this merger that as a 3 year F/O he was sure he would be out of a job?

BTW, I think I saw Mr. "We hate you guys!" in CLT the other day. I thought about asking for an autograph, but figured he might pop a blood vessel.

Again, don't use facts to make your argument. You only confuse them more.
 
How about it clear. Do west pilots and your attorney have any responsibility when it comes to the MOU and the vote?

Judge: "Mr Harper, did you have a chance to review the MOU before your clients voted for it?"

Marty: "Yes your Honor."

Judge: "So, you as an attorney should have know then that the language may be problematic for your clients. Did you then recommend that they should vote "Yes" on the MOU?"

Marty: "Yes your Honor, but we had to make it ripe, my money train was slipping away!"

Judge: "Really?"
