Despite the policy language Nicolau clearly felt bound by the five tenets of ALPA Merger Policy -- he even included them in his report. Over the Award what we have is a simple disagreement: on the one side is the most experienced arbitrator in the country and on the other is a bunch of pilots with a huge sense of entitlement. Whose opinion is really worth more?And why wouldn't he follow terms and guidelines agreed to by both parties? Why should he strike out on his own and come up with his own rules. The fact he didn't think your position was correct made his decision invalid?
