The underlying premise of the APA is their notion of their own DFR trumps the obligations of the MB Statute (including the arbitrators obligation to follow MB).

MB is the fair process by definition. The arbitrators cannot allow the APA to substitute their own ideas inplace of the statute, else it would be unfair by definition.

Heres the other problem, if the Arbitrators go down the road the AOL, Company, APA want, what happens to the INTENT of the law and the ensuing consequences of subgroups that want their own seat in the future?  Will the eviceration of the Statute strip Congress of the intent of the law and cause havoc in the next merger?  What did the AOL PROVE that USAPA couldn't represent their interests when they already voted away their right to the Nicolau award and then demonstrated that they continuously stonewalled USAPA with a recalcitrant "Nic or nothing" attitude?  Doesn't USAPA get THEIR day in court to negotiate under the Protocol Agreement of which the class and craft they LEGALLY represented before the NMB certification change under M-B?

The statute will be followed. The whole dog and pony show from Wake to now has been to placate the unreasonable. The period of placating is just about over.
