YOUR side said that the contract we all agreed to abandoned the Nic, and the same judge said that the abandonment wasn't a failure of USAPA's DFR. So how do you use what was abandoned?

If your new union wants to grant the seat, which they clearly do, there is nothing illegal about it. You won't stop if either. Also, no one ever agreed to abandon the Nic. Your fake unions desperate behavior proves its a very real possibility.

Sure they did. They voted about 98% for the MOU, which they claimed abandoned it and Silver said the union had a LUP for the abandonment. Remember, in 2005 you guys wanted what was valid that day, not before or after.
 
Right, the APA probably could have given the west a seat, but this agreement takes that off the table and leaves it to a panel of arbitrators. Even though Silver said the west didn't have the right, if all parties agreed to give the a separate committee it would have been fine, but they didn't. Just like she said that USAPA's rights changed with SCS, but all parties agreed to give them the rights under MB. Hence the agreement to let a panel decide that point that was in dispute.

Its a waste of breath to try to talk any legal logical sense into to these yahoos. They are just trying to pick a fight and waste time. It's out of their hands and they know it. Just read yesterday's minutes from the BPR meeting. That says it ALL!

Outstanding point!

The legal parties have contractually provided for the continuance of USAPA with MB (regardless of what any dicta about an issue that wasn't even before Silver may have inferred).

And the parties have submitted to arbitration a settled issue about the West Seat (that was ordered by a court, regardless of personal opinions otherwise).

Risk is all on one side. It's always been on one side. Implicit assumption has a way of forcing all the risk to one side.

Did I miss the election by the former AWA pilots?   Did God come down from Mount Sion and decree it?
 
Although I doubt there ever will be a "west merger committee," just why to these nitwits think THEY are the ones qualified to sit on it?  Don't the PHX pilots get any say in this, or are these sleazebags steamrolling themselves into leadership positions that they never earned (or were elected to.)   PHX BPR reps excepted...maybe.  The BPR reps are elected to be on the BPR, not any kangaroo merger committee.
 
How many West pilots voted to be represented by USAPA?  
 
Your concern for valid West pilot representation brings a tear to my eye.

They had many many chances to participate in a meaningful way and took a pass. All because they couldn't have the NIC.

Oh, and while I am wasting my time here, the Nicolau Award is still the only combined system seniority list for all LCC pilots.....

Quite contrary to what the scab union puts out, the Nic has never been vacated by any court of law and remains a valid arbitration result between the pilots formerly in the employ of AA and the pilots formerly in the employ of AWA.....um ...any of those pilots heading for another SLI?
 
That's nice,  but I believe it was voted as nullified by the MOU which the west predominately voted FOR.      In accordance with that.....whatever committee's are involved with with the SLI it seems that they must adhear to the PA,   which firmly states, that the seniority lists that will be used are those that were in effect on Dec 9th.      
 
I see no NIC anywhere around there...

They could have had a say in whether the boat the were sold down the river in was brown or black but took a pass.

Nic4was is more appropriate these days.

Wrong. The Nic has never gone anywhere. I believe that usapa legal counsel and leadership was emphatic in their opinion that the MOU was seniority neutral. Are you saying that your lawyer, the legal team, and all of USAPA leadership LIED to the membership?

Of course those no-ethics scum bags did. But it didn't work. The Nic alive and well.
