US Pilots Labor Discussion 8/25- STAY ON TOPIC AND OBSERVE THE RULES

The point is that ALPA merger policy was followed. There is no arguement to put forth that would negate that fact.

Here are a couple more facts.

The company is a signator of the TA that mandates the use of ALPA merger policy as the method for combining the seniority lists of AAA and AWA. The process was completed with the presentation of the Nic to, and the company's acceptance of the award.

The company considers the TA as a binding contract and has been held to its clauses both in the TA 10 min block hour grievence, and the arbitration involving the out of seniority furloughs. Likewise, they will be held accountable for breach of contract if they abet usapa in any seniority redistribution.

usapa has nothing more than a failed premise proposed by a union busting law firm. The self proclaimed "expert" of labor relations and the RLA needs to go back to law school and get some remedial on contracts and good faith. No worries, that schooling is coming his way "shortly".
This post reminds me a lot of the interaction the esteemed Bill Wilder had with Mitch Vasin. Well documented in the RLA Labor Blog. Vasin, a former AWA pilot had the temerity to try and engage Wilder on the RLA, and the Wake Court. Wilder clearly had a grasp of how far off Wake had steered from course. Black and white labor issues. Vasin was clearly in over his head, stating the former AWA pilots had a case and had actually won. Wilder, absolutely firm in his convictions and knowledge, schooled Vasin in how the AWA pilots actually had a loss couched in their supposed victory. True to form, Wilder was shown to be the one with absolute knowledge of the RLA, and Vasin the amateur in totally over his head. ROACLT again affirms this. Who knows, could ROACLT be Wilder? Either way, both have shown time and again their mastery of the RLA, and have been absolutely right on the way the 9th would rule. The AWA pilots every time, were off the mark. Every time, the former AWA Phoenix Law school dilettantes have been brought up on their leashes each time they lunge. Too bad it has cost the ones who believed over 2 million......
 
"Exactly two?" You forgot the big third one. The one where you elect a new representative entity that negotiates seniority. To use the former is to perpetuate the former. The former is gone.
If its so easy to do, then why hasnt Usapa put out a contract yet with DOH?

Here comes the re-write and the total lack of knowledge. Easy to make all these statements. Too bad the Ninth totally refutes it. Honestly, how can the west pilots be so naive that they forgot what actually came out of the Ninth? To make a statement such as this is a total denial of reality.

Thats funny. The Ninth said the case was not YET ripe. If you fail to Fairly represent the West, it will be Unquestionably RIPE.

This shouldnt matter to you though, because after all, you're in the top 517. Right?

Keep up the DOH with C & R's and it will be Unquestionably ripe. Additionally, if its a slam dunk for Usapa, where is the conract? Whats the delay?

Lucky for you the random testing hasnt caught up to you. You do have to be of good moral character to hold an ATP. Do you still qualify?

Your statement implies the minute USAPA proposes a deal, it is unquestionably ripe. The west pilots failure to grasp what constitutes ripeness and damage is embarrassing. Keep saving your money and making the stupid badge backers. The badge backer proves there is a sucker born every minute, and there is a lawyer available to separate you from your cash, again.

If you feel that is the reason the East pilots left ALPA, that is your right. As one who voted ALPA out, it was a lot more than that.

The westies were told about the proposal by J. Freund and they didn't like what he was telling them. So what did they do? They dismissed him at Wye River. Big mistake for the west. Some one got spanked by Bill Wilder on the blog! The desert judge was going to take the west to the promise land. He got spanked by the 9th. Too bad.

The Nic was the final straw, the reason I threw the match to the pile of straw. The entire mess got swept up in the flames, including the abortion Nic. Burn baby burn!

Hey Swan,

I wonder who gives the west the terrible legal advice? Is it the Ken Cooper wannabee Vasin? Is it the Army of Leotards? Aquaboy or Fergie or maybe even J. Mac? These guys will never learn.............they still think this is AWA/Mesa/Trans States. Gotta get to the next level.
