Do you have any idea what the judge was losing sleep over?

He was losing sleep over the fact that he had let to much about the Nicolau into the trial. You guys really need to learn to put things into context and not make things up.

I believe your post had quotes from a Phoenix District Court case, that was remanded back for dismissal by the Ninth Circuit Court of Appeals.

The bottom part, where he says "seems to me......." sums it all up. If you don't know your way around bargaining agents and the RLA, seems to me doesn't cut it does it? That is why the 9th clerks had to clear him up on what he was in way over his head in.
 
Oh, ok. Who was telling you this all along. Turn on Wings Jetzzz. Look at the latest video. Parker says it all. All they wanted was a clarification like was said. They know when they have to deal with USAPA, they need the fallback position to prevent the West from suing.

Loved the part where you look around and you are the only one holding that position! Well, when you obviously have no background to even begin understanding this matter, you are going to be the only one who holds the position. No wonder Parker has to do this. He has no choice. The 9th says the Nic is not required, you know, the Federal guys, and the west line pilot holds another opinion. And they wonder why we stand "Alone" Not such a lonely place when a Federal Court upholds your position versus a bunch of line pilots. I agree, the part where a Federal Court of Appeals ruling involving a CIVIL lawsuit, not, a contractual dispute and grievance process magically reverts back into the company arena is the classic!
I will ask this. How about you quote the ninth exactly where they say that the Nic is not required to keep usapa from losing a DFR?

Yes it is a quote from the district court. That is what luv was saying. I pointed out that he did not understand what the judge was losing sleep over.

BTW has that case been dismissed yet?

I said everything is community property that has to be shared. How does sharing equate to " give up your 330 and captain positions". It does not . The Nic gives you guys the top of the list. The Nic still has the very greater majority of the top 1000 pilots as east pilots. In the Nic the top 2000 pilots 1450 east.

Further, the 330 fleet has almost doubled, something you would not have had absent the merger.

But with DOH, even with the east's attrition, it would take close to 10 years until I had the seniority to hold the captain seat I have been sitting in for over the last 10 years. That is downright seniority theft.

You can have every single 330 seat they put in PHX and then
you can have every single seat that your DOH gets you in the East.
Until then it sounds like you are whining!!

Um...you believe wrong....still have not seen that mandate from the 9th....case still not dismissed....injunction still in place...usapa still guilty, and clueless.

Better read the official usapa position on that. That is not it. The leadership also wants to steal west growth too.

Better let your union know ASAP, lest they do more things that you will later complain about that you didn't get to vote for.

Everybody? Or everybody who agrees with you? I guess the company's lawyers are not among the "everyone" you speak for. Neither are USAPA's lawyers (the ones you hold in such high regard) since they are going to fight the lawsuit with YOUR money. If it's really THAT dead wouldn't it be smarter to help expedite the process rather than object to it?

More of your lies and propaganda. Someone else recently posted the tally of lawsuits. Looks like USAPA has filed more than the west. Who is "sue happy?" Better check your facts.

BS, as usual the problem is that you preach to everyone with your 'let me tell you how it's gonna be' attitude, and get very emotional when others disagree. NO ONE knows 'how it's gonna be.' Least of all you. That's the nature of our legal system. It is open to interpretation and opinions by judges. That's why everyone is entitled to their day in court. And that's why we are all here as participants in this discussion with nothing more than opinions and speculations.

If you are so confident, you really should try convincing your union so they stop wasting your money and actually help expedite the company's request for clarification. Really. Otherwise, you are wasting time blowing wind here trying to get anyone to believe your... stuff.
 
Man Jetzz, why the focus on the Swan? This is bordering on the obsessive. What is the point? Why don't you PM and save us the attacks? There are a lot of East posters here and you are locked on.

How about I bid for and get awarded whatever seat my seniority holds system wide.

Now ther is a novel concept.

A concept that is lost on posters such as yourself who like to think they are in a position to make demands.

News flash for you Barrister, there is this combined seniority list that has been accepted by the company that does not go by DOH. Any joint contract at LCC will have that list in effect. Get used to the Nic, unmodified and to its terms, cause that is now how it is coming.

BTW, if the company said tommorrow that they were going to move the 330 fleet to PHX, your tune would change in a heartbeat.
 
We want nothing, NOTHING to do with UAL, I feel sorry for Continental.
Sleep well, BS. No need to feel sorry for anyone at CO. Most of the CO pilots are quite happy with what is on the horizon for us. In fact, in meetings with us and CO pilot reps, I can't tell you how many times it is repeated that no one wanted anything to do with your toxic group, and there is no way we are going down the same path. It is the AWA pilots that everyone feels bad for.
