This one you got right. usapa is still under the injunction until the case is dismissed.
But the injunction wasn't issued for what...6 months or so after USAPA passed it's seniority proposal to the company? How long did it take Parker to accept the ALPA proposal?
Then there's this - as you say USAPA was/is under the injunction, not the company. The injunction doesn't prevent the company accepting USAPA's proposal, especially if the acceptance came before the injunction. The injunction only prevents USAPA from negotiating a contract containing that proposal. USAPA would have been able to negotiate the other sections of the contract, as they have been while under the injunction, while waiting for the legal process to work itself out.
So again, if Parker will accept any seniority proposal USAPA puts forward (meeting the criteria) why hasn't he done so. Two answers come to mind: 1) USAPA previous proposal didn't meet the criteria, and 2) Parker means that he'll accept USAPA's proposal if it passes legal muster and meets the criteria.
