How is the financial support going for west pilots, is everyone chipping in?

From what I understand it is going well with the exception of some who feel they are not effected enough to care. However I am not really privy to that info...

Why don't you post a link so we can all find out?

EJ... if you attended (or viewed) the most recent Crew News in PHX... didn't sound to me like Dougie has accepted anything regarding the "lists". He has never once come out and said this is the list and this is our bargaining position regarding the NIC.

Understand your statement about those who do not feel they are affected. I guess you have your version of the 924PS type pilots on your side too.


If you are not privy to the info, I would certainly not be.
 
The Posner(Air Wisconsin) case deals with the exact opposite of what we have here.

Since you'd be hard pressed to find a case exactly like the current situation at US, all precedent goes out the window then.

In fact, the case says that in order to prevail in a DFR case, "The first is the principle that a union's interpretation of its own constitution, by-laws, and other promulgations is entitled to judicial deference; we must be able to call the interpretation unreasonable, perhaps even "patently unreasonable," before we can set it aside " (quote from the Posner case). In other words, Unless the Union's own interpretation of it's C&BLs are "patently unreasonable", then it can implement it's will as it sees fit.

Nice try - this is part of the rejection that the arbitration award violated ALPA's constitution. That was the basic argument the East MEC had filed suit over before being disbanded. The union has wide latitude to interpret it's constitution, but as the "note" I highlighted says, it cannot use that discretion to inflict the majorities wishes on the minority.

You really do have to stop putting words in other people's mouths. The TA gives the company the right in this case to veto any integrated list if it doesn't meet the criteria agreed to in the TA. USAPA's position is that seniority is negotiable - period. It could be changed every 6 months if the union desired and the company agreed. The $64 million question is whether USAPA can change an arbitration award it inherited without running afoul of the DFR.

On the other hand, the lawyers for AOL and AWAPPA used MANY non-RLA industries as references in their briefs.

Possibly because DFR isn't just a RLA issue but the responsibility of all unions...

Why is it that when someone posts with logic, experience and authority, some people who have no intellegent response, resort to off topic attacks?
