I'll say it again, it's better to have a job while looking for a job than no job at all. Now some people will get their wish...they made no concessions and now they could be job hunting on unemployment.

Jim, the BK judge can appont a Trustee in a Chapter 11 situation, as has occurred in the HAL case. You may recall the incident several weeks ago, when a HAL pilot refused to let the HAL trustee travel on one of his flights from HNL to LAX/SFO.

Simply put, under Chapter 11 the Trustee is a manager; in Chapter 7 he is a liquidator.

Is it possible for the shareholders of the old ( u ) to pursue litigation for the cancelation of their stock, should management seek to preserve this ( uair ) stock ?

It only seems right for management to cancel this stock also, but RSA owns 38%. Maybe that is the reason for preserving this stock.

No, management's lack of a cogent business plan, their dishonesty, and their failure to honor agreements are at fault, and these actions poisoned the relationship between management and labor. Add the willingness of the give away gang to capituate to all unsavory concessionary offers by management, and it became a recipe for failure.
