Jumped on to see if I missed any news lately....hmm, 175 pages......one MOU and one letter each from USAPA, APA, and AOL, and 175 pages of pissing contests!

About what I expected. A lot of you guys could save time by typing up one form letter post and just have your computer log in and insert it in the thread 8 or 10 times a day. Would give you a lot more golfing or fishing time. Cleardirect might need 2 computers running to keep up though. :)

The Nic is ignored because it ceased to be a bargaining position once ALPA took a powder. Plus, as you guys ratified by an enormous margin, we have a side agreement (the MOU) that prevents APA from taking over the process. USAPA will not determine the "new list," that will come from either negotiations with APA, or possibly arbitration.

Too bad you chose Nic or nothing. I think you have left a lot on the table by not realizing the Nic is dead. Right now, I think your access to WB aircraft going forward will be limited.. But I have no say, so no worries for you.

So if, "USAPA will not determine," the new list," and only USAPA and the APA are negotiating, who has the legal right/justification to modify the Nic? Since you don't like the idea of the APA telling you what the seniority list is, I have to ask who is representing the west if USAPA plans to modify the Nic?

I'm well aware of and would expect a fence around American's widebodies. Thank you for your concern, but you and the average westie will have the same access. You do realize don't you that we both work for US Airways, right?

The issue of the TWA lawsuit came up on Dec. 19 when American asked U.S. Bankruptcy Judge Sean Lane to approve the new APA contract, which includes the Supplement CC arbitration process. As I remember, the point of APA and American Airlines was that the contract and the bankruptcy process overrides any previous agreements, whether losers in the deal like it or not.
 
Nobody is modifying the Nic. It will never change, because it is what it is. It was never about modifying the Nic. Even ALPA never saw it from that perspective.

It has always been about section 6 negotiation that modifies, ie. replaces the current CBAs, and it always will be.

Even the MOU reiterates that.

I think our union ahould present the seniority list I saw in the PHX crew room. It will have conditions and restrictions to protect the interests of ALL the pilots of US Airways.

The company can drop it's appeal,,,that is fine,,AOLhas no problem with judge Silver's ruling that places uscaba on "dangerous ground".

In reference to Claxhole's post, and Hummer's contention that AOL is coming between LCC and the merger, not even close.

Remember, it is the West that voted 98% in favor of the MOU. Meanwhile, it is uscaba that runs a second time to the the bankruptcy judge Lane(who already told them once to get lost) trying to make itself relevant.

Face the facts Luv.

Uscaba is a lame duck, soon to be gone mistake that cost the majority of LCC pilots very
large sums of money.

AOL is completely in favor of the merger, and is still representative of the majority of West pilots.

The Nic is still the only accepted system seniority list at LCC.

According to you, they've been toast for a long time now. And why is Doug getting fed up now. It sure took him a long time. Or are you just passing time while acting as a DDR?

Does anyone know the case number for the TWA lawsuit?
