Thank you for posting this. I've been saying this repeatedly and it's nice to see it stated by a company lawyer. How many times have do the east jihadists have to be told that they can't cherry pick the outcomes of these court cases and run around with their heads up their butts yelling victory?

The Company is clear that they desire either a judicially sanctioned seniority list, OR a process to resolve East/West seniority in a manner which insulates them from liability. What the Company is saying is that the Nicolau is the list unless a court says otherwise, OR the West pilots voluntarily relinquish their rights to the Nicolau.
Some more advice, that lawyer is smarter than USAPA's or AOL's lawyers.

You should hear the logic I was told why usapa has to wear uniforms everywhere. It's as absurd.
Winning is one thing, collecting is a completely different ballgame, and usually the side with more money wins. I don't like it, but it's true.

Keep quoting the lawyers who forget to mention the 9 th, you know the same court the slammed the western Wake jihaad. And also oversee Judge Silver. Too bad when you try to sue USAPA, it will be long gone after the fact.
You may certainly be right there Bean, I don't know. But you have to ask why lawyers say what they say. Did you read that letter from US to the NMB and think at any point "What a crock!"?
I think this will come down to who has the smartest lawyers and I don't know who that is.
One of the smartest things I've ever heard was from a PSA pilot about their strike. It didn't work out to well and I
asked why. He said something like "when things like a strike happens both sides start spreading a bunch of BS, and you have to be careful not to start believing your own BS. We believed our own BS." Not sure who is believing theirs.
Monoliths can be tricky things. Ya'll be careful out there.
