CEO of US Airways will spend one day in jail

Let's look at this objectively.

4 time DUI offense : Last offense seperated by almost 20 years

3 Offenses in his twenties : Bad pattern, but AZ law doesn't account for the other 3. Probably a reason for this.

Alcohol blood level was .01 points over the legal limit. Not a sign of exessive drunkeness, but over the legal limit nonetheless.

Those three facts don't amount to DP being an alcoholic, but do warrant an evaluation to see if more dots can be connected to uncover an alcohol problem.

Most of us humans here on this site...excluding the inhuman ones...have skeletons in the closet. Some of DP's have been exposed. If he truly is an alcoholic he won't be able to hide it now that there is a spotlight on this particular issue in his life. If he's not then 20 years from now we'll talk about how we had a CEO who made a stupid personal decision to drive some friends home after having a few. JMO
 
The only thing I question is, Why only $1600 in fines? I hear of people getting $4000+ for their first offense. Just seems a little cheap.

Indeed, I agree on that point, but the dropping of "20 Over" appears to be a serious Violation of the Code of Law Enforcement, IMHO. Who "fixed" the speeding violation is another issue, but not one that "U" should be concerned with as Corporate Employees. That should be a local PHX issue.

I am totally on topic. If you bothered to do a little research, you would see that the previous fines have all dropped off; they were too far in the past. If an hourly person had done this, they would receive the same exact punishment in Arizona.

In what "harsh way" would an hourly employee be dealt with? Doug will be further tested for alcohol problems, and if there are problems identified, he will have to deal with them accordingly. An hourly employee would be directed to EAP (at least at US, not sure about AA...)

Oh, and by the way, I know a lot of people who don't think the seniority thing is "cute"... at all. Take care! ;)

If you are asked by the company to take a breathlyzer and you refuse...you are terminated. If you take a breathlyzer and the reading is above the legal limit...you are terminated.

There is EAP for those f/as who seek help, and that's before the company has been alerted to the issue and actually performs the testing. After the fact...its too late.

I suspect he was fined for the speeding violation...receives some points on insurance etc... there's no jail time for speeding 20 miles over the speed limit.

I recall a time where the company terminated a f/a who was already in EAS. The EAS (company employee asst.) underminded the f/a and reported her as non-compliant with the voluntary program for missing for illness or being late for some sessions. Meanwhile, EAS was voluntary by the employee. Well, it took 14 months to get er job back and reinstate her with much threats and negotiation.

My recommendation...no one should volunteer to go to the COMPANY EAS program. They should only volunteer to go through union EAP with any issue...be it drug, alcohol, or emotional/behavioral.

"At a hearing in Scottsdale City court, Parker "accepted full and total responsibility for his recent DUI charge by entering a guilty plea to this charge (against the advice of his attorney)," US Airways said in a statement."

Rescheduling court appearances is as routine as tying ones shoes.

I marvel at the self righteous on here who are so high and mighty and eager to pass judgement. If he does it again I WIL have a totally different point of view.

The “guilty plea against the advice of his attorney†statement is exactly what attorneys are paid to write for the press releases. It is classic damage control when the client is guilty.

Let’s see should we spin for:

1. playing the squeaky clean victim (aka Duke Lacrosse)
2. spin for I was there but it was consensual and misunderstood (Kobe Bryant)
3. maybe take the moral high ground (aka “I take full responsibility.†Janet Reno).
4. or maintain complete denial (aka I did not have sex with that woman.)

I yawn at the feeble attempt to obfuscate.

His guilt is a matter of judicial record, conceded when the judge accepted the guilty plea.

Parker gets no glory for pleading guilty as if he somehow found it within himself to “avoid the temptations of his attorney to plead innocent.â€

He got busted. He is getting different treatment from the company than the employees feel they would receive. And no one has foolishly tried to deny that.

Some acknowledge what Parker has conceded and are protesting his preferential treatment.

Others throw around accusations of self-righteous, high and mighty, an accusation which (in contrast to Parker’s situation) has not been conceded to any judge, self-appointed or otherwise.

Who is guilty of what? You be the judge.

I believe being cited for a DUI has everything to do with "public safety". He was carrying company employees with him.

His job as CEO is to maintain an ethical standard for the sake of his family, the company, shareholders and media scrutiny.

CEOs are replaceable, my friend. I have been around a long, long time. U's gone through 7.
And since 2001...5 in the past 5 years. When did you come on board?

The Media has this already. It came to light because the CEO drank to much got behind the wheel drove at an excessive speed while impaired. The greatest damage was done by the CEO himself.

Ok, but what if you receive a DUI as a FA? Are you immediately terminated? Plus, isn't there some sort of "side letter" now that states you are not automatically terminated after your first offense while on duty?

The laws of the State of Arizona were applied EQUALLY to Mr. Parker. If I would have plead guilty I would have recieved the same penalty.

This to me is encouraging news. He plead guilty and faced the music. While one can certainly debate the severity of the sentence, there can be no debate as to the fair and equal application of the law.

Let's move forward shall we. Living in the past serves no one.

Arizona law is 30 days first offense (10 days actually incarcerated) work release during the day if required for work. After incarceration you then would have to complete 36 hours of alcohol awarness programs. Lest we forget the ignition interlock AZ requires.

If you are among the masses and you pleaded guilty you would face 10 days in tent city, work release daytime.

Its in the USAirways policy and procedures. It states you "may" not be automatically terminated. I did not see that applied while I was there. We had to fight to bring f/as back usually on "last chance agreements" or not at all. I have heard that the company gives a f/a "a last chance agreement" if there is a good argument. Almost always there is suspension (without pay) pending further investigation.

What hurts US employees is a CEO who gets tuned while hobnobbing on the company dime and then tries to drive himself home.

Actually, not quite right. The law provides that the jail time can be reduced to one day under certain conditions. Because there was no previous DUI recently, Doug fell within the parameters to get the nine days knocked off the 10-day jail sentence. The fine was about right for around here on a first offense, which is how this was treated because of the law.

The only special treatment Doug got was being allowed to have the case heard a day early so the press wasn't hanging around like flies. IMO he got just about every consideration that the judge could grant, but then again he pleaded guilty and didn't waste court resources by dragging it out.
 
As everyone knows, the legal concept we call "Double Jeopardy" prevents the state from convicting a person on both counts.

It being tried on the same charge twice,not separate charges.He was charged with two different offenses....
