Yes. Of course. You can't acknowledge the real truth of the matter. This dispute has never been about compromise, it has been about keeping an extreme windfall vs. keeping at bay an extreme windfall. That is why Prater is gone. Simple.

As much as Silver wants a settlement on the SLI dispute, the resolution to the dispute will not likely ever come in the form of a settlement (you guys already did everything you are willing to do and now you are along for the ride) but rather it will simply work itself out in the course of time and the process that is appointed, and anyone meddling only serves to delay the outcome but won't really change the final result too much.
 
Yes Silver wants this case finished. She sees that usapa is the problem. Otherwise why would she constantly reference the poor decision from the ninth?

You are right about one thing. It is usapa is not about compromise. It was about the east taking from the west. Usapa never offered anything it was all about concession from the west not compromise.

BTW care to explain something? If usapa is so willing to negotiate a settlement why appoint an ad hoc and spend $100,000 on a committee with no authority?

Read usapa's C&BL. Ad hoc committees are not authorized to negotiate. Yet again usapa trying to BS the court.

So what, the hard core DOH ad hoc committee shows up and tells the west they can't negotiate but they need to make it appear usapa is willing to move off DOH but not really.

Pursuant to the Court’s resolution of the motions for summary judgment,
IT IS ORDERED Counts I and III of the complaint are dismissed and judgment is
entered in favor of US Airline Pilots Association on Count II of the complaint. US Airline
Pilots Association’s seniority proposal does not breach its duty of fair representation
provided it is supported by a legitimate union purpose. This judgment is binding on the
following class: “All pilots employed by US Airways in September 2008 who were on the
America West seniority list on September 20, 2005.”

DATED this 4th day of December, 2012.

Judge Silver ORDERED the parties to negotiate. USAPA complied and even budgeted the event, by a vote of the BPR.

Judge Silver is simply off the reservation telling any labor union to negotiate outside the RLA, counter to their CBL, and with so called special pilots demanding status.

But USAPA does as ordered. Just like when Wake soiled his career by holding a kangaroo court and imposing the NIC as a bargaining position. USAPA complied until the Ninth ruled against his actions.

Same circumstances, same bizarre PHX courts, same West Class hoping one of these local, biased, and illegal orders will somehow stick and give them the NIC. Not going to happen. At least 40 years of labor law supports that premise.

Simply amazing some in the West Class are faulting USAPA for this latest round of wasting our time negotiations. I seem to remember it was the West Class that put us in front of Silver.

Yes the west pilot have offered something. Injunction. Another arbitration to let yet another arbitrator decide between an arbitrated list or a made up list. Usapa rejected that.

What did usapa suggest? You west guys shut up usapa will treat you in what they think is fair while trying to integrate with American

What usapa really said was that they would throw the west under the bus in order to get a better deal for the east compared to American.

Why so scared of the fair process? Why not allow the west at the table for M/B? Afraid the arbitrators will agree with the west, again.

You earned it with your hard work to get hired, im adament to defend it, and most if not all union houses will defend it......it is yours....if you dont like it you must quite to relinquish it.... K

Sending a committee with no authority to negotiate is not complying with the order.

Just because you don't like the judges decisions does not make them biased. Judge Wake gave usapa a chance to make their point after complaining to the ninth. When asked to prove their accused " bias" usapa shrunk into the corner and admitted their was no bias.

But please file something against judge Silver. Accuse her to her face instead of whining from the background.

Don't ever forget the only reason we are in front of any judge is because you east pilots failed to live up to your word. Failed to comply with an arbitration. Failed to treat the west pilots fairly. This is east pilots fault.
 
I agree. Lets find a solution together, somebody who doesn't have a dog in this fight like an arbitrator.... Oh wait, we've done that. Lol

This whole episode has made a mockery of arbitration, the courts won't make a decision and management won't manage.

I've lost a lot of faith in our entities designed to resolve conflict.

Snap?...It's entirely just an issue of two tiny, numerically insignificant portions of the human race failing to reach any viable agreement. Nothing new to see there...sadly enough. Reasons exist for the great empires/nations of the earth to field massive military machines...and it sho' 'nuff ain't 'cuzz we, by nature, get along with or even play well with others. It just "is what it is" and I'll hope that none involved choose to continually carry this twisted little experience to their graves. There are far better things to do with life, among which is to pause at least a moment on this day to remember, salute and honor our fallen.

I know! How about a worldwide symposium where...Air line pilots.....come up with valuation system that takes a measurable and objective approach in establishing where a professional pilot ranks in the marketplace amongst ourselves. Oh that's right, airline pilots are too good for that.

I'd figured you for being on the "same page" there snap, but, and by no means seeking out petty differences here sir; imo this day's purely for those who gave their very lives for us....period. The fallen are the true Heros, and should never be lost from our collective memory.

Blame the EAST pilots all our fault, you get more ridiculous as each day goes on. I believe were in front of a JUDGE, because someone filed yet another lawsuit that has no merit! USAPA's DOC 108 is a nice easy read, try it! MM!
