Ohhhh PUHLEEEEEEEZE!

...and this from one of the more reasonable west posters!
I've got news for you man: There is not a trace of angst, let alone PANIC out here.

I'm reasonable because I don't hate East pilots. I hate the association and the dysfunction which comes along with it. I found common ground with East pilots outside of our dispute. I'm just turning the tables on what I have read about AOL running out of money, just a few West pilots, we have wasted our money, things falling apart out West.

“Of course, in negotiating for a particular seniority regime, USAPA must not breach its duty of fair representation. Accordingly, if USAPA wishes to abandon the Nicolau Award and accept the consequences of this course of action, it is free to do so. By discarding the result of a valid arbitration and negotiating for a different seniority regime, USAPA is running the risk that it will be sued by the disadvantaged pilots when the new collective bargaining agreement is finalized. An impartial arbitrator’s decision regarding an appropriate method of seniority integration is powerful evidence of a fair result. Discarding the Nicolau Award places USAPA on dangerous ground.”

Then tell us, Dave. You refuse to move off Nicolau. Yes or no? If you're so righteous, answer the question?

“In this instance, despite a year of negotiating efforts, there was no agreement on a list. Subsequently, the Representatives choose the Undersigned as Board Chairman and opted for the Med-Arb process. Those mediation efforts, held over the course of five days in October 2006, were similarly unsuccessful. Thereafter, the Parties agreed on the arbitration ground rules, and, pursuant to the Policy, each chose a Pilot Neutral from ALPA's Pilot Neutral Master List as a nonvoting member of the Arbitration Board.”

No one here is in any kind of "panic mode"...are you projecting now?

The Soviet Union collapsed as a result of SDI and restless republics and Warsaw Pact countries who were tired of being behind the Iron Curtain. USAPA faces an onslought of challenges internal and external. Would you not think there is a little bit of concern with the members of the politburo? If not, they are too busy rearranging the chairs on the Titanic to notice.

THE COURT: Well, I said they do not have to adopt

Nicolau. Okay?

If you hate USAPA, then you hate East pilots by association because the cause of the MAJORITY of your PROBLEM is the vote the MAJORITY of the East pilots cast FOR USAPA when the NMB election process was finished and ALPA voted off the property. It doesn't matter how much common ground you find with East pilots, you'll always HATE us for voting in the ONE thing that cashes your righteousness: USAPA.

Ughhhhhhhhhhh.....

Back to lurking.
Absolutely. Another $100,000 down the hole. We need to go into the court and tell the Judge there is no middle ground and take it to appeals. Hell, the West is going to do it anyway, so let's just go back to appeals court and put more crap on the docket.

Screaming now. Things must be going very badly for your side.

What is your problem with finding a swift, correct and legally binding solution?

Is it the swift part? The correct part or the legally binding part?

Are you so lacking of confidence in your defense that you you don't want a swift correct or legal end to separate ops and this seniority fight?

You are aware of injunction ordered by federal courts correct? You do understand that a federal court CAN order usapa to use the Nicolau list correct? Judge Wake ordered that. It was only removed because of ripeness not because he did not have the authority.
West pilot failures. This sore is a festering boil that the APA will eventually have to deal with in PHX. As I have said all along, Parker needs to spin the East into American and keep the West as a separate entity.

I hate USAPA's poor decision making which includes frivolous lawsuits against the pilots it claims to represent. I hate the lack of transparency which tells me that USAPA has a lot to hide.

I hate having to fund career politicians who simply shed their ALPA pins only to suckle off of USAPA's tit.

Ain't gonna happen. You can hope and wish all you want.

That just tells me how weak you think you case is. It you thought you were winning you would want the west so we would all be junior to you. But by wanting us gone you admit that the Nicolau list is what you are going to live with.

What is it you all say? The west is young and the east is old. All Parker has to do is wait a few years and his biggest problem will be gone. East pilots. No need to split this up you east pilots can take our poor attitudes and go.

BTW APA will take care of the real boil usapa very soon. I would imagine that the west and APA will get along just fine. You east pilots have proven you can't get along with anyone. Not even yourselves.
