My guess is USAPA is moving off DOH. AOL is not moving off the NIC. I have been on the inside since day one, and this time there really is a firm lockdown. Believe it. Nothing getting out. I am making all this up. Not a real clue.
Judge Silver already told Marty USAPA did not have to use the NIC. Marty has been asked by the judge to provide real evidence of a DFR. He has been told the van ride, the formation of USAPA, and Judge Wake's fiasco are "old news." Has he been saving something for future use? Don’t think so. He has nothing.
The West Class is now doing its most ultimate freak out. The away team is now down on planet USAPA behind closed doors, all wearing red shirts. These AOL undercover commandos are once again (just like Wye River) faced with real negotiations and real opportunities for compromise. But they cannot budge, even if offered LOS or some favorable fences and restrictions. Nic or nothing. So ordered by a bunch of 2004 hires.
No injunction. Ripe. Dismissed. Judge Silver hopes for the best, but that will be her ultimate ruling.
Siegel will crawl back to Parker with yet another loss to Silver. His reputation as a servant of his master will be intact. His reputation as having even the most basic understanding of what a contract is and all things NMB will be stained forever. At least I think Harper really believes in his cause, as does Pat. But not Siegel.
The East will never forget the betrayal by Parker and his henchman Siegel in doing a 180 on ripeness. Noted.
Parker will get his merger, labor strife will continue to be front and center. I predict after the POR, the East pilots will have nothing to lose. But there will be no work actions.. All involved will only give exactly what is contractually required. But no more. Ever.
