How exactly does LOS service throw anyone under a bus?? Let the West have their NIC by name or by C&Rs in their PHX base.

Leonidas, LLC was created in August of 2007 to safeguard the legal rights of the
former America West pilots in the face of the multiple threats before them at that
time. It was founded by two America West First Officers; Eric Ferguson and Jeff
Koontz. Those two pilots were introduced by a Merger Committee member by
the name of Kevin Horner who is now at American. In early 2008, the group
expanded to include Captain Roger Velez, from the Merger Fund Management
Committee. Since that time, the group has grown to include these nineteen
individuals (in alphabetical order):

No, there is not another re do. Let's finish the battle. The West insisted Nic or nothing, and never was willing to compromise. DOH with c&r s. this thing is over and done with. I am not willing to open another door for a surprise. If you give AA a 7 yr fence and 10 on the bigger stuff they will bite.
The West is going to sue with anything you propose. If you think you can compromise, you are mistaken.

Bingo, not taking clear's offer. They wanted this to be a battle, refused to talk. so now we are at the end and will see this to it's rightful conclusion of fairness. Every other airline knows how screwed up the NIC was, thus the change in the process.

How do you get there if you are refusing the offer to arbitrate? Do you think the judge dismissed? She told the parties to see if we could work something out. We offered arbitration. What did usapa offer? Nothing. They said sit down shut and we will tell you what you get.

In addition to your facts, Southwest, Air Tran handled things without going to arbitration under the M/B laws.

Correct, SWA and AirTran reached a ratified, negotiated SLI agreement. As I recall it was basically slotting by LOS and position. No equipment factor necessary, as all the 717's were being sold to Delta. The relative size of the two pre-merger operations also came in to play in setting up the ratios used.

When AirTran initially balked at the proposal, the counter from SWA was, fine.... we will just sell the 717's without planned replacements, basically shutdown the Atlanta operation, furlough the resulting "excess" pilots and staple the rest. Talk about hardball! Here's an example of the overall attitude SWA took with AirTran:



Too bad the East didn't take this approach with the West early on.

That's a laugh. No doubt, the first available arbitrator would be Nicolau, since he isn't doing much these days.

You should not have a problem with having him do it again. You guys can make all those arguments you have been making with us. You can tell him all those things ALPA missed and that he got it wrong and now has a chance to correct it and be the good guy in your eyes.

You should be asking for him because you told us he knows he was wrong and the world has been telling him that.

I have more than a passing interest. And why do you assume I flew anyway. Horner was there, and he has no interest, yes?
Let's get back to your recent interest in arbitration Gay. Why so interested all of a sudden? Thought you, Prechillil, Resdoyalpolygraph,Nic4me, Fergie and the rest of the fun bunch clearly stated that Silver was going to grant an injunction, and impose Nicolau.
I say you saw how badly this is going to end for you. Even Horner is begging for compromise. And it is going to end badly for you. No doubt.
Szymanski has clearly laid it out for Silver. Seigel matters nothing. His opinion is flawed and wrong. Roland Wilder wrote a brilliant trap for Silver. She is now more than aware of what lies in wait if she dicks this up like Wake. It will be much worse from the 9 th. Roland Wilder knows this issue inside out, and just because you don't makes it even more fun. Harper is in over his head so far I felt bad. Szymanski just has to sit still a little longer, and you will be wiped off the map. The esteemed judge can't meddle and she knows it. All USAPA has to do now is get her to order something, anything to try to force USAPA's hand. Tick tock......
