If Marty/LEO and Pat/USAPA reached an agreement on a compromise list by Monday, that list would still have to be ratified in a CBA between East and West. A complete contract would have to be voted on, all sections.

The West Class says ripe, and says the NIC was voted on by approving the MOU. How could East and West have voted on a list that did not even exist until “Monday?” Specifically a list that is indeed not the NIC?

No three way. USAPA represents two pilot groups under two seniority lists and two contracts. We are a National Union, just like ALPA.

I have seen this diversion coming for a while, especially from Parker...give the West a seat at the table. I say no way, not until they get enough cards to throw their bargaining agent off the property, and get their "own" two way.

Snap, do you see any scenero where the NIC will be the list? I really want to know. I have been asking that question here for years, and never a real answer, other that it will be "imposed."

A divorce and equal representation could be a plaintiff offer of settlement. Can USAPA agree to that even if they want to? Would APA go bat ship at USAPA agreeing to give a vindictive West class the ability to force this mess into three way arbitration?
 
Courts do not mediate, arbitrate, or impose seniority lists, in any way, on individuals covered by the RLA and managed by the NMB. What they do is rule on damages after the act is done, via a DFR.

The TWA pilots have already won, but they will not be re-slotted or placed on any seniority list other than their current one. What the court will do is attempt to do is render damages for wages and lifestyle lost.

Do you think the TWA pilots would have had a case before they were placed on the bottom of the APA list? Nope.

This is all so basic, I cannot believe anyone on this forum for more than a few months would continue to believe a court is going to mandate a seniority list.

Not going to happen. Silver may be taking us all through a faux TV Perry Mason episode, but in the end will rule on the law.

That does not make sense. Logic please, and I know you are under a lot of stress right now. Is Silver going to take you "out" of your union? How? Is she collecting cards?

You guys have constantly been after the west to negotiate even though we have no separate representation or way to negotiate. Now the union you guys created can't negotiate for you? C'mon guys. Really?

Bean, USAPA is your union. You don't get separate representation, nor the ability to separately negotiate. Nor do the DCA or PHL pilots. And I did not say USAPA could not negotiate for me, only that when they do I get a vote. Really?
