September 16, 2014 USAPA Update

Today USAPA filed a declaratory judgment action in North Carolina state court seeking a judicial declaration that the National Officers’ decisions to defer the commencement date of the dissolution of the Association and to defer distribution of its assets were consistent with their authority under the USAPA Constitution and Bylaws, which actions were supported by the BPR. This declaratory judgment action was commenced because various statements and prior litigation made it clear that litigation over this decision was inevitable, and, as set forth in the complaint, there is “uncertainty, insecurity, and the threat of ongoing liability.” In view of these circumstances, it was determined that the best means of assuring USAPA could function to fulfill its responsibilities going forward, for, among other things, collective legal action on behalf of the pilot group, including seniority integration, was by having a court involved. We will keep you apprised of developments as they occur.

Don't get the West excitement though. It was a given, seeing the numbers, that APA would be the majority. And they take over. This is the American way. Nobody has a problem with it.
The changeover is just like an administration change in this country. Big deal. Fully expect the APA to act like every other political entity.
And if you really think the APA is going to use the Nic, you are honestly not being realistic.
They are going to try to stack it for their people.

Pretty much, and I somehow expect the sun to rise over very much the same world tomorrow as it did today, but we should let the west kids have their fun regardless. Naive innocence, once lost, can never be regained, and they'll lose theirs soon enough anyway.

So right, I don't understand how the west thinks the APA would even consider the NIC, after what they did to TWA, Air Cal and Reno and want to do to us ( east and west ), I guess more lies and false hope from their leadership.

This is what Contemp of Court looks like. It surprises no one, but you can bet it's already on the Desk of Judge Silver. The USAPA "Constitution and Bylaws" is nothing more than an operating agreement of an LLC that was the former bargaining agent of a pilot group. It's absolutely, positively meaningless.
Which brings up an interesting point in that the legal action in Silver's court would appear to be nullified ( as was ALPA's in DC ) as the party to the suit is no longer.

However, AOL is basing everything on its legitimacy - class status - granted by Silver. Which they to apply for a second time when DFR 1 was dismissed.

Yeah, but I will have 1985 seniority by the time this is done.  Good times!

I was on DCO. Streble and the company have been notified to cancel DCO. USAPA no longer exists. I am a member of the APA.
 
Welcome to APA! You will be able to log on to the APA Website by 6 AM Central tomorrow. Below are the instruction on how to reset or change your password on the APA web site. Please note while your APA status is PAA, C&R will not be accessible. Once you are voted in at your Domicile and your APA status changes, you will then have C&R access.
