The ALPA UELs and then the USAPA UELs have a long history of poking an entity in the eye that the UELs want to reach an agreement with through the use of extortion. Throughout the US Airways pilots history the UELs poked management in the eye. Now USAPA is using that tactic again, which will most likely fail because APA will not give in to extortion. In Document 28, footnote 2 USAPA said, “As APA concedes, its unfair treatment of former TWA pilots in the seniority integration dispute arising from the merger of American and TWA was the reason Congress adopted the McCaskill-Bond Amendment. See Document 26-1 at 18."
The M-B Amendment was a result of the AFA and AFA MEC obtaining Missouri congressional delegation support. The AFA convinced Claire McCaskill and Kit Bond to support legislation to attachment the M-B amendment to the Omnibus Spending Bill.
Why does USAPA poke APA in the eye by incorrectly telling the court the basis for the M-B statute and then expect APA to agree to USAPA’s revised draft PA, UMTA, GA, and MBLS offer?
I have never understood the UELs strategy to hurt or embarrass a party as a means of extortion to force an agreement. This strategy has never, ever worked before and I suspect after nearly one-month since USAPA submitted its SLI/USAPA dissolution proposals (which are a secret being kept for the US Airways pilots) will work this time. Just like a negotiation with a terrorist no entity can ever give in to extortion and I suspect APA may just wait until SCC before actively speaking to the MC again. I hope I’m wrong…

He has no credibility with a small minion group and the company and the rest of the East pilots think nothing of him so he finds solace and comfort in those that he thinks listen to him......West pilots.
