Slots
  • Sell the 8 Washington Reagan slot pairs that JetBlue currently leases from American to JetBlue at a price approved by the DOJ
  • Divest an additional 37 slot pairs at Washington Reagan to the federal government for the DOT and/or DOJ to redistribute as they see fit.
  • Divest 10 slot pairs at New York LaGuardia to the federal government for the DOT and/or DOJ to redistribute as they see fit
  • Sell to Virgin America the 15 slots (7.5 slot pairs) that Virgin America currently leases from American at a price approved by the DOJ
Gates
The following gates would be available for use by competing airlines under a common-use scheme. The merged carrier would be allowed to continue using these gates when not requested by other airlines.
  • Relinquish access to Americans gates on Terminal Bs Pier 2 at Washington Reagan along with the slot divestiture
  • Relinquish access to US Airways five gates at Terminal 2 of Chicago OHare and make available five gates at Terminal 3, Concourse G
  • Relinquish access to Terminal A-East at Philadelphia
  • Give up Americans gates at Concourse A at Charlotte, and make available 5 gates on Concourse B
  • Relinquish access to gates at Terminal 3 at Los Angeles, and give up the rights to 2 of the 4 new gates granted to American at the new Tom Bradley International Terminal

In regards to the sell off the west fantasy.  My six year old does that, making up stuff when he doesn't get his way.  He has an excuse though.  He's only six years old!

You mean for you?  Remember we couldn't agree, so we had mom and dad come over to settle it.  Who was the one that threw the temper tantrum and went storming out of the room, when they didn't get what they wanted?...........  Yeah, I thought so.

The Aspire Aviation "what if" settlement proposal is fairly well written and supported by facts.   I agreed with most of it except for the LAX gate situation.   Assuming the merger occurs,  new AA won't be very much larger at LAX than UA.   DL, AS and UA have the use of terminals 5-8 and nobody gave up any gates at LAX as a condition of their mergers.   LAX is actually one bright spot in that it is so competitive and no single airline dominates (or will ever be able to dominate) the domestic traffic there.
 
To suggest that new AA give up whatever gates US gets in T-3 plus two of the four new TBIT gates is a little over the top.   UA and DL have enough gates to park their mainline and regional ops at Terminals 5-8 while AA is stuck with UA's old regional dump on the far east side since the Eagle terminal has to be torn down for TBIT expansion.   For the government to demand that new AA give up LAX gates which would hamper AA's ability to grow its TPAC network from LAX would be unreasonable.   
 
The other nit-pick I had with their analysis was any suggestion that new AA give up LGA slots.    New AA would have about 31% of the slots, compared to DL at about half.    When the slot swap was proposed,  DL was the largest airline in the world and the government demanded some slot concessions that limited DL to about half the LGA slots.     If the government allows this merger, it would be unreasonable to demand that new AA shrink even further at LGA below the 31%.   
 
agree fwaa  even w 31% slots in a merged aa/us   dl would still have what about 70% or more from the slot swap deal

Is there some indication that the government intends to be reasonable?  That would certainly be a breath of fresh air, but don't hold that breath waiting, either.
 
Back in the 1970's the DOJ pursued a antitrust lawsuit against AT&T which led the the Bell System Divestiture and the creation of seven regional Bell companies.

If the DOJ feels so strongly that consolidation in the airline industry is bad for consumers, along with stopping this merger, they should begin to dismantle DAL and UAL. At least then their policy and practice would be consistent and even handed. Of course that won't happen.

My guess is that just about the time everyone is resigned to commence the trial and all chatter regarding a settlement has become silent - the parties will settle.

After all, who wants to have their turkey dinner, half cold, away from family, delivered to a conference room somewhere in the District.

Yes, they will settle.  If not by the Friday before Thanksgiving, certainly early in Thanksgiving week so that all the DOJ weenies will be able to catch their US Airways flight to their hometowns to be with extended families.  (And that may be the last round trip they will be able to go non-stop out of DCA, once they have their way!)
