She said holding up the merger would hurt the airline industry by leaving American to carry on "as a below-average, poorly run carrier with a long history of safety concerns."[/SIZE]

AMR-US Airways Merger: Attorney General Hopes to Resolve Dispute Without a Trial
 
WASHINGTON WSJ.com) - Attorney General Eric Holder on Monday said the government is willing to settle its antitrust lawsuit against the merger of AMR Corp. and US Airways Group Inc. if the airlines agree to broad concessions that would preserve competition.

[SIZE=10pt]"What we have tried to focus on is to make sure that any resolution in this case necessarily includes divestitures of facilities at key, constrained airports throughout the United States," Mr. Holder said Monday.[/SIZE]
 
[SIZE=10pt]Settlement conversations with the airlines "are ongoing, and we hope that we will be able to resolve this short of trial," he said at a news conference announcing an unrelated settlement in the pharmaceutical industry.[/SIZE]

[SIZE=10pt]If the airlines don't meet the government's demands, the Justice Department is prepared to proceed with the trial, Mr. Holder said.[/SIZE]

[SIZE=10pt]The Wall Street Journal reported Sunday that settlement talks [/SIZE]were under way, with the department insisting on a broad package of divestitures. The airlines were preparing an offer that included concessions at multiple airports.

[SIZE=10pt]The attorney general's comments were the latest signal that the parties may be able to reach a deal before the trial, which is set to begin Nov. 25.[/SIZE]

It’s likely the DOJ wants the airlines to give up slots at not only at Reagan National but also New York’s LaGuardia Airport. “We continue to expect this dispute to be resolved via negotiated settlement, potentially before the trial even starts but no later than year-end, paving the way for the merger to close immediately thereafter,” Bryan said in a research note sent to investors Monday.[/SIZE]

I read an article in an airline magazine recently about Long Beach, I think it was Airways. Now I will state ahead of time that Airways is not the absolute authority and Long Beach isn't DCA. But it said that Long Beach is slot controlled(locally?) and jetBlue controlled most of the slots there, with other airlines wanting in. Perhaps if jetBlue gets more slots in DCA, they should have to give up an equal number of slots, by value, in Long Beach. That would be how many, all of them? ;-)

 How big of them! Give up gates at an airport with plenty of gates. But then again, they are Southwest and shouldn't even enter the equation. It's not like they carry more pax than any other airline in the US or anything.

Not to be a conspiracy theorist but....
Indigo partners just sold there shares of Spirit for around half a billion dollars.
Indigo partners bought Frontier from Republic.
Indigo partners home office is in Phoenix.
Denver paper article said Frontier would scale back flights at Denver.
Indigo partners is owned by William Franke.
William Franke is the turnaround expert that Arizona governor Fife Simington encouraged to take the helm at America West during their 1994 banckruptcy, he then subsequently handed the reins over to Doug Parker in 2001.
DOJ want a broad divestiture to allow the merger.
Soo, its all just speculation, but....
Could Usair and American get approval from the bakruptacy judge to allow a modification of the POR to sell off the West operation in Phoenix to Indigo partners. Creating a significant sized carrier based in Phoenix with the combination of the West and Frontier. Thus not only divesting of certain city pairs, but allso creating and promoting competition in the market place.
This would also solve the integration issue Usair has been unable to achieve.
Pure speculation, anybodies thoughts?
Anything is possible in this merger. AMR/US Airways could spin PHX to Indigo, include them in one world and open code share at a later date. It would give Franke a low cost in with Frontier and AWA gates combined to give SWA and Alaska fits out West and would solve a lot of the East/West frictional problems here. Let's hope that occurs.

Did Holder miss the memo... In August the Assistant Attorney General said,
 
"If anybody wants to come to us to propose a settlement, we’re always prepared to listen. But our view, looking at the evidence before us, is that the right outcome here a full-stop injunction."
 
 
​Now that Holder is speaking publicly about the DOJ position (in the context of an achievable and desirable settlement rather than an inevitable necessity to press on toward a full-stop injunction)  it appears he is starting to play his last cards to shape the endgame talks.

Divesting anything is far too large a price to pay.  Unfortunately,  Parker will do absolutely anything to see this merger happen.
 
Post merger, the new AA will have second tier hubs on the East coast as far as a European network goes, and still no solution to the Pacific network..
 
And an LCC side of the operation with much higher costs.
 
We may be the largest but will definitely still be the weakest in terms of network.  A merger with LCC is the final nail in the coffin for AA.
 
 
 
 
Look west, DL and AS are starting to piss on each other…  AS at least brings valuable west coast traffic vs. PHX.
 
Look east, B6 has what AA needs to solidify on the East coast.
 
The LCC AA merger is gonna suck!

You contradict yourself. If they give away "everything" how will they still be the biggest? How would AS feed AA? At SEA where DL is making a major push, or with their other point to point service? That would be just like how PSA fed USAir and we know how that worked out. B6 has what AA needs? Then why did AA give it away to B6 in the first place. Don't quit your day job to become an analyst.
 
I know you hate to weaken the bloodline, but hang in there, you'll be okay.
