AAA/AWA Seniority Integration

FINAL RESOLUTION

WHEREAS the AAA MEC, on behalf of the AAA pilots, has requested

that the Executive Council set aside the Opinion and Award in the

matter of the Seniority Integration of the Pilots of US Airways, Inc. and

the Pilots of America West Airlines, Inc. (the “Awardâ€) and resubmit

the matter to a new Arbitration Board sitting with a different

arbitrator, and

WHEREAS the Executive Council has given full consideration to the

AAA MEC request, and the opposition of the AWA MEC, over the

course of several meetings,

THEREFORE BE IT RESOLVED that the Executive Council finds and

determines as follows:

1. As found by the Executive Council in July, ALPA Merger

Policy provides that ALPA’s role in seniority integration “is solely to

provide the process†and that “ALPA National†is confined to “a neutral

position on the merits.†Under Merger Policy, when the parties submit

their dispute to arbitration, it is up to the Arbitration Board, not ALPA

National, to decide how best to express the Board’s view of the equities.

2. The Executive Council has also previously found that, given

ALPA National’s role is solely to provide the process for seniority

integration, the issue before the Executive Council is limited to

whether the Association has done so in this case. No evidence has been

presented of any impropriety in any aspect of the process.

3. Based on the foregoing, the Executive Council concludes

there is no basis for the Executive Council to further consider the AAA


MEC request to set aside the Award. The Executive Council further

finds that there is no basis for setting aside the Award, which under

Merger Policy is now to be defended by ALPA as issued by the

Arbitration Board.

4. As required by the Transition Agreement between the

Association and US Airways and by Merger Policy, the Award is to be

submitted as issued to US Airways management, providing that the

Award may not be used prior to completion of a single collective

bargaining agreement.

5. Both MECs are required to continue to work with the Rice

Committee and the Joint Negotiating Committee process to bring about

consensual solutions that will furnish a basis for successful completion

of collective bargaining on behalf of the AAA/AWA pilots with US

Airways.

In a series of votes, ALPA’s Executive Council today passed four resolutions that address issues raised in the ongoing merger of US Airways and America West.

The resolutions settled four outstanding issues:

1) The Council made a firm commitment to support a fast-track negotiating strategy to raise the pay of AAA pilots in order to achieve pay parity with AWA pilots and to achieve major raises (pay parity plus) for both pilot groups. These negotiations—which will move AAA and AWA pay rates beyond current AWA levels—will be conducted by the Joint Negotiating Committee (JNC). Specific terms for timing and retroactive payment will be negotiated by the JNC.

2) The Council found that there was no basis to set aside the seniority arbitration award issued in May by an arbitration board. The Council concluded that no evidence of impropriety or failure to follow ALPA Merger Policy had been presented. ALPA will now defend the award. The award is to be submitted to management as issued, but with the proviso that it will have no effect until the parties complete a single collective bargaining agreement.

3) The Council confirmed that the $2 million previously approved from the Major Contingency Fund to support AAA and AWA pilot groups is for strike preparedness, communications, and family awareness activities directly attributable to joint negotiations. Upon resumption by the AAA MEC of participation in joint negotiations, the MEC can submit a communications plan and MCF budget that will allow it access to the funds.

4) The Council determined that there was no basis under the ALPA–US Airways Transition Agreement to contest the operation of US Airways under a single FAA operating certificate with separate operations that keep the aircraft and pilots of AAA and AWA apart until completion of a single collective bargaining agreement.

These actions came after months of presentations, debate, legal analysis, and communications with the MECs and line pilots. The focus will now turn to the next round of joint negotiations to achieve an improved CBA for all pilots at US Airways.

Not only did they not do their job when the should have, they took the opportunity to try to sully their opponent by fabricating a sickout in coordination with the help of the company.

What else can ALPA stomach in the name of the union?

The list wasn't enough for Pohn Jater. But the appearance that they have added slime tactics by floating a sickout by their opposition timed exactly with the passing of the list...

ALPA has shown they have no shame to how low they will drag the profession to save themself. They can't see far enough down the road to see they will loose both.
 
Wasn't it all you west guys saying we have to honor the current CBA and language if USAPA is elected? Isn't the closed shop language part of that contract? Or is it just selective enforcement of the contract provisions? If you participate, you can propose to have that language removed for the USAPA negotiated CBA.

ALPA will have a short term victory if they cram down the list and the Joint Contract by the end of the month.

The only way ALPA wins in the end is if the company is immediately sold and broken up before USAPA has a free and fair election.

ALPA and the company will be working overtime to prevent free and fair elections by a quick merger. And since ALAP writes "Flying the line" they will sacrifice their members in true ALAP fashion, and never acknowledge their deeds.
