Gary Hummel had open heart surgery on Monday and is unable to participate in the upcoming Addington trial. Bradford is attempting to use the Appeals Board to trump the BPR by overturning a majority vote of the BPR that the officers disagree with and is attempting to usurp the power and the will of the majority of the elected Board of Pilot Representatives by letting 2 Appeals Board members overrule the Boards authority. This is truly beyond the realm of the Constitution and Bylaws of our Union and the founding principals of USAPA that we all voted to support.

Before I left office PHL & CLT filed a group grievance against the company for disparate treatment of pilots for medical disqualification due to the fact that the President of the Union after having a near fatal heart attack and stent operation was medically disqualified yet shows current on the company roles. In simple terms he is not only not using his sick leave but is accruing 5 hours of sick bank when medically disabled from flying due to loss of medical. Who would not like those benefits? As domicile chairman Paul DiOrio and I have a responsibility to all US Airways pilots active, inactive, and LTD to ensure we all have the same negotiated benefits applied to the pilot group. A union official is being treated beyond our contract.

We are now getting USAPA resistance followed by adverse General Council legal opinions stating our grievance is out of order and the Domicile Chairman cannot file a group grievance. To prevent them to use this tactic we need a number of pilots to support this grievance to prove that the group exists; we need to get more names on the filing. Please pass along to all pilots in your own words and email you know that agree to following the rules of our union by supporting this grievance by adding their name. Please forward the request to phl@usairlinepilots.org; clt@usairwayspilots.org; grievance@usairlinepilots.org.

What is occurring by the current slate of officers is the absolute most corrupt actions ever witnessed by union officials. If they dismiss this grievance we are enabling their corruption and are weakening our union principals.

Are you suggesting now that if Bybee and either Tashima or Graber rule favorably to the west position in the upcoming DJ matter that the SCOTUS is going to come and save the day for east pilots? That's really, really funny.
Why am I not surprised you still can't start your case with the SCOTUS standard or any articulated injury in fact?

There was a time when you showed some willingness to engage in an honest consideration of the situation. Now you won't address a very simple concept (judge the final product in light of the SCOTUS standard), but instead you venture off in making illogical and dishonest accusations with more implicit assumptions of your own.

There is no basis to assume Tashima and Graber will abandon the SCOTUS standard that they pointed out to Marty. There is no basis to assume Tashima and Graber will suddenly abandon their sanity, as the West is so eager to do. :lol:

Final product judged against the SCOTUS standard... Anything else is completely devoid of integrity, a great fear of the West, of course. Wink. Wink. :lol:

It's not my case and I have absolutely nothing to do with Marty or AOL determines is or is not important to include in the prosecution of their case. All I know is what I read here and in the court documents. My comments are based on what the players are actually doing and saying.

Tell you what, why don't you quote the salient points of what you are referencing regarding the SCOTUS and I will be glad to comment using my layman's interpretation of the issue? Fair enough?

P.S. You do recall that I have repeatedly stated that I think the DFR-II case is destined to be a loser for the west, right? First off just because Silver is nailing USAPA to the wall as of late really means nothing when it comes to reading the tea leafs on how she will rule in the end. Second, even if the west wins with Silver I suspect the Ninth will rule just as the did last time unless the merger is completed by that time and some form of measurable harm is proved by USAPA's failure to implement the unmodified NIC.

Perhaps that clarifies why I didn't respond to your previous inquiries on the current west strategy.

Ok, sure you don't have any points you are trying to prove. Fine. Marty himself said he wanted USAPA to carry the burden of proof that belongs solely to the plaintiff. Perhaps he got it from you. :lol:

I tried to edit my last post but was unable......The original discussion here was about contingencies, which we plan on daily in crossing the Atlantic, unlike domestic flights. You are the one who tried to make it personal......breeze

What is the intent here? To have a new slate of officers in place before we go to trial this week? To have a new slate of officers before we commence seniority negotiations with APA under M/B if the merger goes forward? These are the two proximate events that need the union's full and undivided attention. Ain't gonna happen. If the BPR representing CLT and PHL prevail now, what do they accomplish besides further distracting the union at a crucial time. Can Hummel's medical issue not be dealt with a few months from now? If he is violating the consitution or the UOM it will catch up to him. What's the saying - when elephants fight, it's the grass that is destroyed.

The intent? When you vote for the inmates to run the asylum, those questions are irrelevant.

I'm happy for you Breeze. Congrats on your recent transition.

The big picture is SW pilots making a significant higher salary flying 737's over land than the 330 drivers going over water. If we are discussing plans and contingencies, I have never seen a worse case than US.

Your group would have made enemies of any airline tied to US. If it were not the HPilots it would have been someone else. I recall US getting off to a bad start with United. Ya'll were telling them how YoUS were going to run the place, take the 747's etc.

Y'all create this thing called USAPA which ensured division. It would not have mattered which pilot group was on the other side, you'd be dealing with dysfunction
as a result.

We've asked many times what is your plan B? You've never had a plan B because in reality there was never a plan A. That's what happens when you make decisions based on emotion rather than rational thought.

So let me see if I comprehend your logic: Syzmanski says that Hummel is critical which is why the ask for a continuance which Silver said she won't grant. So now that Hummel is in the Hospital Syzmanski sits at the table ALONE. So why have him in office anyway if he can't even run the union except with the empty suit left at the table. Oh, that would be Bradford. And you guys wonder why the pilots are where they are and always will be for quite some time.
