Naaaaa, the current agenda is to put McKee in as President, and put DiOrio and Crimi on the NAC. That should really get things moving, huh? NOT!!!

All of this will be moot once the APA takes over.

I'm really glad we dumped ALPA and have USAPA.

But, I will be just as glad to see USAPA, and all its associated political nonsense, give way to the APA.

My guess: I will be retired before I am sick of the APA, which is likely how I would feel after a few years. I'm sure the APA has its own brand of nonsense.

That is a wonderful example of "implicit assumption".

It's why you guys will never get a DFR conviction to stick and you will never get damages.. Unless you start with the law, the SCOTUS standard of DFR, you will never be able to demonstrate how a final product is a breach of that lawful standard.

But let's be hypothetical.. Wake didn't get ripeness correct but he also made the same implicit assumption the dissenting opinion made at the 9th. Any judge that begins with an implicit assumption, rather than the SCOTUS standard, will just travel a deeper rut than Wake.

"DFR claim is not ripe" means the Ninth declared a lack of jurisdiction and was unable to evaluate the merits of the plaintiff's claim. Once again - 0/1 on the merits.

Correct. The Ninth majority rendered no decision on the merits. Wake and Bybee believed ripeness was achieved and both determined USAPA committed a DFR violation. On the merits in federal court USAPA has never found a win.

Well USAPA was dismissed with prejudice so not nearly the same thing.

Don't forget Bybee will be there too.
