Are you saying she ruled on ripeness for the DFR against USAPA? Unless she actually ruled that it is ripe and she will be judging USAPA's DFR, I would be cautious about assuming what she can do, and what she intends to do. Remember how you think Nicolau tried to help out when he sent the disputing parties away to do more homework.

I think you are missing Silver's point of settlement discussions. Her order requiring the defendant to enter into discussion with the plaintiff is a very interesting approach when the 9th took great aims to steer clear of interfering with an internal union dispute. Before anyone assumes too much into what she intends to do, or even has authority to do... think it through.

I think she wants a way out. She wants something definitive, since that's what the company and AMR want. She wants arguments that might allow her to make a definitive ruling, and she's giving both sides time to come up with one. The problem is, the Ninth already placed limits, and the NMB has already ruled that only ONE union represents ALL LCC pilots. She's stuck and she knows it. The only definitive ruling that's open to her now is to find the argument ripe, which the Ninth already said isn't so, and then find against the west in a DFR. Anything else goes back to the Ninth so fast it will make your head spin.

I want to see how hard she spanks the west if they show up with an off-the-wall, BS argument that gives them more than they had with the Nic. The spanking would be so hard, you'd hear it in PHL. I don't think that even Marty would try that, but his cluelessness has surprised me before. Besides, she doesn't want the aguing in her court, she wants it dealt with before anybody shows up there.

I wasn't there, but I wish I was, just to see all the dejected westicles with heads hanging as they left the courtroom. I can't wait to read the transcripts. If some of the quotes I've read here, posted by the westies by the way, were actually uttered, I'll be laughing my arse off!

She's not done yet. I think she is giving the parties one last chance to compromise and then she will do what she is legally obligated to do.

Silver understands usapa is the core problem, in a sense the company is required to deal with terrorists and that is a difficult position to be in. It will be interesting to see your lawyers come off DOH- just like Nicolau urged you to do. Isn't that interesting!!!!

That doesn't surprise me. Everytime I've heard him speak I've been impressed. Doug hires the best. That's why we AWA pilots are so friggin' incredible. B)

The company isn't neutral. They've used this division in the Pilot group to earn some big bucks. They see a way to make this thing stretch into the new company and possibly make them even more. They say they are neutral and want this thing finished, then they interject themselves into it in a way that makes it drag on for years. This isn't new.

Judge Silver is being played and she doesn't even get it.

The company has no loyalties. I am surprised how much effort they placed in promoting AOL's case as ripe. And Silver totally surprised everyone with her request to compromise.
