If the rumored words of Judge Silver today are true, then a lot of people on this forum need to now eat their words about the Nic. That includes self-appointed-labor-law-expert stock clerks.

I was there, Judge Silver wants each side to come off DOH and the NIc. I'm fine with that because the pilots of the acquiring airline got screwed with the Nic. We'll propose a position which is fairer to the West pilots.

Guaranteed

Glad to see you finally agree that the westies have to pay their dues, just like everyone else.

What happened to the part about you being "all in"? Better save your back pay when you get it. Marty will be calling to collect.

So- you boys ready to compromise and give up DOH? It sure sounds like the judge wants you guys to come back to reality and take the Nic with C&R
And surprisingly USAP is now the lone defendant.

Remember AWA acquired USAir, so I think what he is saying is that he sees this as an opportunity to finally get a proposal more favorable to the West than the Nic that was such an injustice to them.

Exactly. What do you want to bet USAPA's idea of compromise is DOH............ with C&Rs.

I could not help but notice Dean sitting on the isle and Courtney against the wall. Their body language was very telling.

It may not be the Nic but it's not going to be DOH. Nic was the compromise. The top 500 are not going to be happy.

Exactly... I'm looking at case precedence - TWA (bk) and American version 2. Put the top 330 captain half way down the AWA list.
I'm glad you are set to compromise. :D

Its interesting that a preliminary injunction hearing turned into this. Hmm...

If you were there, didn't you get the impression Judge Silver had to be educated by US Airways. attorney, Siegel? I have to admit, he was the best attorney in court today.

I'm glad you're so happy about being wrong regarding the hearing. Better look up the meaning of "compromise" though.

Go ahead...make your play. I'll venture that Judge Silver won't see any humor in it. You're really asking for it if you walk into her courtroom with that next week.

May 12, 2013 transcripts, UAL CAL Seniority in house alpa arbitration.

United mec and alpa national merger comitte pilot David Smith testimony.

MR. FREUND: With that, we will call David
15 Smith.

Q Good afternoon.
3 A Good afternoon.
4 Q Could you state your name, please, for the
5 record?
6 A David Smith.
7 Q David, do you mind if I call you Dave?
8 A Please.
9 Q Dave, could you tell us where you're
10 employed, please?
11 A United Airlines.
12 Q What do you do for United Airlines?
13 A I fly as a 767/757 Captain based in
14 Denver, Colorado.
15 Q And how long have you done that?
16 A I was hired on April 4, 1985, so a little
17 over 28 years.

And then from there, in 2006, was elected
7 to and served a couple of terms as a Merger
8 Committee Chairman at United Airlines for the MEC.
9 And as a result of that, served at ALPA -- for ALPA
10 National on the Merger Policy Review Committee.
Q Was there a particular reason that you
4 understood that this particular timing of this
5 committee was related to the timing and the
6 formation of the committee?
7 A Yes.
8 It was due to the rather unsuccessful
9 outcome, as viewed by some, of the US
10 Airways/America West seniority integration.
11 Q Okay. That was a seniority integration
12 which is commonly referred to or often referred to
13 as the Nicolau award.
14 A That's correct.
