April/May 2013 Pilot Discussion

Do you think it is ethical to take your anger out on West pilots and make them scapegoats because an arbitrator handed a decision to both parties who sat at the table and agreed to a process? All we expected was a person's word meant something. These past few years have taught me more than the half-century prior learning about human nature. I must say I am disappointed.

I remember hostages being held for 444 days by "angry students" in Tehran. I've been held hostage by angry FO's in Charlotte and by Ayatollah Bradford for 1846 days.

Lawyers and courts make justice a very slow process. I'm more confident than every justice delayed is just that...delayed.

The first injustice was the Nicolau award.

Maybe I'm missing something, but I don't see how it's illegal. It works just fine for merging US Airways and American pilots. It just may not be the road to a three way do-over that you thought it was. It is after all neutral on seniority.

The thought that the MOU is illegal because it doesn't include the Nic is a big part of the west's case.

"“We don’t need to boil the ocean,” chief operating officer Robert Isom told the managers. “Everything doesn’t have to be integrated.”
The fleets, for example, are largely distinct and should be operated that way. American largely has Boeing aircraft, while US Airways uses Airbus. About 20 percent of merger items will remain separate like the fleets, Isom said. But he added that American could borrow US Airways’ maintenance and pilot training for Airbus, and save time and expense."

Imagine that! Everything doesn't have to be integrated and the fleets will remain separate. Doesn't sound to me that, management is in any "rush" to complete the operational integration of the fleets and therefore the pilot SLI. They have every intention of letting the "New process" as stipulated in the MOU timeline proceed. That process specifically calls for a SLI timeline and methodology, Judge Silver will not interfere with this process as agreed to by the four parties, AMR, LCC, APA and USAPA.

Excellent quote. Do you have the link? Can you forward it to USAPA to contradict what AMR tries to point out in its already weak attempt at AwFOL support?

Nice post Jamie- you're figuring it out. How's that headwind feel?
The only "wind" out there is the "wind out of you're losing a$$". Here, read this and weep: :
"Pursuant to the Court’s resolution of the motions for summary judgment,
IT IS ORDERED Counts I and III of the complaint are dismissed and judgment is
entered in favor of US Airline Pilots Association on Count II of the complaint. US Airline
Pilots Association’s seniority proposal does not breach its duty of fair representation
provided it is supported by a legitimate union purpose. This judgment is binding on the
following class: “All pilots employed by US Airways in September 2008 who were on the
America West seniority list on September 20, 2005.”
DATED this 4th
day of December, 2012." Oh, and:

To the extent US
Airways believes the Court erred in its summary judgment order, it should seek relief from
the Court of Appeals.

Accordingly,

IT IS ORDERED the Motion to Amend/Correct (Doc. 194) is GRANTED. A
separate amended judgment shall issue.

IT IS FURTHER ORDERED the Motion for Relief from Judgment (Doc. 199) is DENIED.

DATED this 4th day of December, 2012.

You guys are DENSE. Oh, and LOSERS!

I have made my peace with the situation. Looks like next Tuesday the NIC is going to be imposed on our pilot group by Judge Silver, following her declaration of ripeness. Now that we have another airline company commenting on our seniority dispute, there is no way we can prevail. And on top of that, Parker has turned on us, having once said he was neutral in the matter. I have always trusted that man to the right thing, it is surprising he would act in his own interest..stunning turn of events, unseen in the past.

Probably on Wednesday, the Company will post the award as the official list, and our positions on the list will change in catcrew. I will move down 700 or so numbers, and probably lose my 76 award on the ensuing system bid. I wonder how many West Captains will come East? I am sure not looking forward to going on reserve.

I know you are probably all surprised I am throwing in the towel, but the law being quoted here on this forum by the West Class is overwhelming. I really thought we had them having won in the Ninth, and again with Silver. But they are all against us. Resistance is futile, they have us, it’s over.

You're RIGHT! You're absolutely RIGHT! How completely IGNORANT I have been until you came along and revealed the TRUTH: IT'S OVER! We're DOOMED....DOOMED, I TELL YOU!

What I find particulary telling is no West poster, to my knowledge, has ever posted a legal document in it's entireity for all to read.

Just an obsession with each and every document as it's entered into the record - followed by cherry picking of some paragraphs that seems like it might support AOL followed yet again by feverent back slapping and high fives about "victory".

Please explain your accusation, it makes no sense.

Your question was: "How can an arbitrated award be an injustice? " If you honestly meant that as anything other than a joke...well...I don't think I can help you much right here. Here's one hint though: Did the Lord God perform the arbitration, or was it an instrument produced by merely an imperfect human being?

I didn't know the biggest part was the MOU being illegal. Here I just thought it helped activate ripeness. Wow, I'm learning new stuff on this forum everyday.

So...The Mayans were just off by a few months? Cool. I say we hold an end-of-the-world party! :)

PS: Kudos to Greeter for the dry delivery, which enabled the joke. :)

Don't be dragging the good Lord into this. I might have to start quoting stuff like, "thou shalt not steal another's seniority." :)

So you can't answer my question- not surprised. You guys are the KINGS of baseless commentary. :)
