US Airways Pilot Arrested

EXACTLY!



Given the style of outfits I've seen on occasion in various airports, there is a lot for the whole world to see sometimes....even on 15 year old girls. If a girl presents herself in public, she (and her parents) need to exercise the level of discretion appropriate to that public space. Of course, if this guy was going out of his way to photograph things that aren't presented publicly, then he should face the justice system and let it mete out any penalty.

Absent some history of similar deeds, he should take the court's punishment, apologize (for what it is worth,) and move on. He should not lose his job over a one-time misdemeanor, although if I were in his shoes I would be hard pressed to show my face at work again anyway....even if I was innocent. He's already convicted in the minds of most no matter what the courts may decide, and that would make life among opinionated jerks pretty difficult.

Please note the Bold part of the above. The part in bold is blaming the victim and without going further back into the thread it looks as if "Oldie" did not make the comment. Therefore my apologies. Which further point to why a rush to judgement is dangerous for all parties involved.

Now then the bolded portion is a text book example of blaming the victim and will not go unchallenged as long as I'm around. It matters little if the young woman involved made Jessica Simpson look like a Prison Matron and was dressed in an outfit that would make Madonna blush is in a word Irrelevent to the alledged charges made against the man in question.

In my mind the pilot in question is in Military parlance supposed to be "An Officer & a Gentleman" and if found guilty he is most certainly NOT a Gentleman and IMO therefore he should NOT be an officer either. The best one could say is he exercised bad judgement and so sorry but I don't want a pilot who if convicted will have been shown to have exercised extremely bad judgement in command of any aircraft I set foot on.

If convicted I think her should be sentenced to 30 days at the state penitentiary in Graterford, PA in the general population where he can gain a much fuller and deeper appreciation of what unwanted sexual attention feels like from the victims point of view. Heck I'll even buy the Preparation H :lol: Perhaps after that experience he will become "Rehabilitated"

I actually DID make a similar statement. You need to read the post to understand the context.

You know, you guys are making my point about people convicting others without the facts perfectly.

I thought that just Sunday morning I read something about "not bearing false witness".

Go back through the thread. I've stated in every post "If Convicted". The pilot in question needs to have the evidence against him tested in open court in order to establish guilt or innocence. Where the "problem" lies is this case in it's current form will be plea bargained away with no jail time as it is likely a first offense and also not a felony.

The second problem is NO ONE knows the accuracy of the media reportage which in this "If it bleeds, it leads" ratings competition world facts tend to fall by the wayside. All the more reason to have the evidence tested.

Even if aquitted or plea bargained away the pilot will likely face a civil lawsuit that could leave him bankrupt, which in some ways would be the least of it as his reputation will be forever tarnished no matter the outcome.

Which brings me full circle to the "Exercizing bad judgement" comments I've made.

You don't understand law very well.

To prevail in a civil lawsuit, there has to some form of "damages", and you'd have to convince a judge that the victim was somehow monetarily damaged.

Even in a criminal case, you'd have to prove that the victim's privacy was violated. That was my point earlier. I didn't see what happened or talked to REAL witnesses, so I would NEVER jump to a conclusion on something as serious as this.

You sound pretty biased for some reason, so I wouldn't let them put you on the jury if I were his attorney.

I don't pretend to know the law but I think "punitive damages" could be awarded in a civil lawsuit under these circumstances. But of course that would be dependent on the statutes in that state. And they vary from state to state. And I have no idea what the statute is in PA.

As I said before....I'm going to wait and see how this plays out.

Pilot Surrenders

Well according to this report police found "incriminating photo's". Now we all know the police never embellish right? So let's see what happens.

In Civil tort there are usually "Compensatory" damages and "punitive damages". Compensatory damages are for personal injury, time lost from work, psychological damage etc etc.

OTOH, Punitive Damages are designed to financially punish a corporation or individual. The theory being that if it cost them enough money it will be a significant barrier to keep them from doing it ever again, whatever "it" is?

Even if the pilot were to be found not guilty the victim would have a cause of action based upon the different standard for conviction. One being "Reasonable Doubt" and civil being a "Preponderance of the Evidence" the classic example of being found not guilty criminally and guilty civily is the OJ Simpson trial. This situation could very well end up the same.

Biased? I'd say more like being raised to respect women and deeply disturbed by the events of the day. That young lady could have been my Step daughter from my marriage to "War Bunny" or it could have been my neice. I'm not amused even a little bit. You have no idea the effect of something relatively minor like upskirting can have on a woman of any age. The effect is magnified when the vistim is young. It's like the character on Law & Order says, I speak for the victim
 
If I were the DA, I'd be applying for a search warrant for any computes/pictues in his home - I'll bet he has a lot more inappropriate pictures of minors. Probably even some of his teenage girl softball players over the years.

The DA probably doesn't think he can justify that type of warrant in this case. Considering the fact that he on the escalator behind the girl when he took the pics, it's pretty unlikely that he would have been able to snap a similar pic as a softball coach.

A US Airways pilot has surrendered to police on charges he took inappropriate cell-phone photos of a teenager at Philadelphia International Airport.Philadelphia police say Joseph Pereira, 55, of Wexford, Pa., is awaiting a bail hearing on invasion of privacy and harassment charges.

US Airways spokesman Morgan Durrant says Pereira has been suspended pending an investigation.

Police say a witness reported he took a photograph up a girl’s skirt at an airport newsstand last week. A district spokeswoman says Pereira resigned as a girls’ softball coach at North Allegheny High School, near Pittsburgh. District spokeswoman Joy Ed said there had been no other complaints about Pereira in 13 years of coaching.

It was not immediately clear if he had a lawyer.

They should search his computer, to rid this world of a pedophile or child pornographer is ok in my book.
