Rand Paul Detained by TSA

Guess you never been to Ben Gurion Airport, at TLV.

Your plane is escorted by an armored personnel carrier and you park away from the terminal and are bussed to the terminal.

It must have been a while since you were in TLV. They have jetways now.

They always had jetways, that procedure was for arriving flights.
No, they did not always have jetways. The only jetways at TLV are in terminal three which opened on Nov 3, 2004. Until then all flights were boarded and deplaned at hard stands and buses were used to ferry the pax between the terminal and the planes.

From what Rand Paul said today, TSA told him(privately) they have a quota system to do random pat downs and the scanner is apparently programed to kick out passengers at a preselected rate.
Thereby blaming a mechanical malfunction. Paul was allowed to go through the scanner again w/o any problem.

TSA has a blurb on their site disclaiming this.

Well, I'm sure then you got a pat down by the girl.......you do know what they say about guys with big feet.......or do I have to source that for you?

What is important to note is the following paragraph from the latest court case regarding "Administrative searches".

B
[2] In Davis and its progeny, we have established a general
reasonableness test for airport screenings. “An airport screening
search is reasonable if: (1) it is no more extensive or
intensive than necessary, in light of current technology, to
detect weapons or explosives; (2) it is confined in good faith
to that purpose; and (3) passengers may avoid the search by
electing not to fly.” Torbet, 298 F.3d at 1089 (citation omitted);
see also Davis, 482 F.2d at 913; Pulido-Baquerizo, 800
F.2d at 901.

Justification (1) is the most troubling. Fact is that in order to effectively change this it needs to be tested by the SCOTUS and ultimately struck down. Failing that, Congress could and should IMO hold up funding the DHS until a clear consensus is reached as to what level of intrusion is reasonable under Davis. Right now we have an agency run amok and the proper balance between Liberty & Security has not been established. Until such time as that occurs we have neither Liberty nor Security.
 
I like the ruling today from the court. Probably needs to be in another thread. A great ruling for the Fourth Amendment.

These gentleman are commonly called police officers. They are not soldiers or Marines walking around US airports in full battle dress.

I kind of wonder why those police officers in the last picture are carrying around CAR-15's. With the penatrating capablities of the 5.56 round I'm not sure you would want to open up in a crowded terminal. About a month after 9-11 I saw a CPD officer at ORD walking around with a Mini-14. Window dressing I guess.
