Machinsts Union Files Claims Against Us

Our "genius" law firm did a nice job of proof-reading this. NOT!! See #7 in the document. (Pasted below.)

7. By this Application, the IAM-represented District Lodge 142 employees formally request an order directing the Debtors to pay an amount not less than $26,9000,000.00 on an administrative priority basis, as post-petition wages and benefits earned pursuant to Bankruptcy Code sections 503(B)(1)(A), 507 and 1113.

Now before everyone rushes to judgement, remember the motions are usually filed electronically and I am not sure if the court or the donlin, changes them to a PDF format.

Number 6 is has the right amount:

6. As a result of the relief granted in the Interim Order and the subsequent Order authorizing the Debtors to reject the collective bargaining agreements, the IAM-represented District Lodge 142 employees have an administrative claim in the amount of $26,900,000.00. This amount
represents the following:

Good luck. Hey, didn't you vote yes for the current wages? Why would the debtors owe you anything? By voting yes, I would assume that whatever clause kicked in from the previous would be now null and void.

My loyalty is not blind. I do not agree with everything the IAM does and I work from within to try and change things for the better.

markkus,

You could very well have a point here, at least as it pertains to wages/benefits. But as the saying goes, nothing ventured, nothing gained.

The retirement is something of a different story, however, since the IAM never consented to it's termination. What will be interesting here is the probability of a somewhat double claim. The PBGC will almost certainly file a claim for the amount of underfunding.

He's a good guy! I've met him! He just overdoses on the IAM Kool-Aid from time to time. Mostly I just like to break his ballz over his blind loyalty.

I must have missed what you don't agree on with IAM. Can you expound on that or do you keep the laundry private.

At most, you might get the difference between what PBGC gives and what was originally funded. I have a feeling the company will find a way to reduce or eliminate it, especially if the cash burn is not reduced. Fuel will be above $65 / barrel and it will never come back until someone has the stones to change the demand curve world-wide.
