Correct. That being the case, the Trust won't be broken and the Match money won't be available for distribution.

When they lost the Summary Judgment in BK, rather than filing the 1114, it pretty much cemented the fate of being able to break the Trust.

No. The money in the pre-funding Trust was separate from the BK and any values tied to that process.

That's the reason why the Match language was written the way it was and there wasn't language which would give us a payout in the event the Trust wasn't broken, as suggested by others. Creating language in that way would have created value outside of the Trust and would have been subject to the total value of the CBA which means we would have to offset the Match value with something else in order to reach out 17% cut.

I want my $6500.00 of Medical "value" still owed to me and under "my" name (as a letter sent to me clearly shows) when I retire from this Company.

As that arbitrator said, you're not due that unless the Trust is broken because the money in the Trust is for the use of the "aggregate," not the individual.

You really should read the decision.
