I believe NYer is closer to being correct. Reason being:NYer the two contracts are both separate contracts. We do not and have never had a JCBA so Legally what power does any governing body have to force the two groups into JCBA talks?
Unions usually go into JCBA talks because ultimately it’s going to benefit the separate groups to have one single contract. But again can you show me where it’s a Legal requirement that they must?

I believe NYer is closer to being correct. Reason being:
TWU/IAM association is the representative for BOTH the TWU and the IAM. Therefore if it goes to section 6 the bargaining for the TWU cba would be done by the association. The IAM cba would be done by the association. It would make no sense for the association to negotiate two separate agreements that eventually would have to go back to JCBA talks. The association would then have to take the two cba and merge them anyway.
