American Airlines Loses Ruling On Union Election

I figured the federal judge would see through that crystal clear. Thank goodness. Just let them vote. If it's defeated, well it is what it is. If it's approved, more power to them.

Most agents seem to be doing just fine.

All in all, the agents seem to have fared pretty well so far.

“Replacing long-term loyal employees with high-turnover, minimum wage workers who get no benefits is unconscionable,” Porcari said. Some cargo agents in Miami have been replaced with minimum-wage workers, he said when asked for details.
“In our restructuring, we worked hard to preserve as many jobs as possible at American, and we did not reduce base pay at any jobs,” Hicks said. “American is contracting with companies experienced in these functions who, I’m sure, pay competitive wages in order to attract quality employees.”

"Texas judge," "Terrible decision?"

Election Dates Set!
American Airlines agents will vote for representation beginning Dec. 4, when voting instructions will be mailed, and ending Jan. 15, 2013, under a schedule announced Nov. 1 by the National Mediation Board.
It’s about time,” said Ted Tezino, SRO. “This shouldn’t have been in the courts in the first place. To all the agents out there who are undecided, I say wake up and see what’s going on! The company is not on our side.”
In fact, American Airlines management has indicated that it would appeal the decision to the U.S. Supreme Court, threatening to continue its frivolous legal actions to deny us our democratic right to vote. The company has wasted nearly $2 million on legal actions to stop us from voting – not including bankruptcy attorney fees!

AA will stop at nothing to hold its workers down. Let them vote and stop trying to twist the laws around in ways that they weren't intended. They are worried about the employees being disadvantaged, except those that want the union. What another example of piss poor management. Big surprise there!

Look for AA to make sure all the buyouts are off payroll by Dec 1, if they're not already gone.

Did you help write the playbook

"American is trying to disenfranchise agents' right to vote, by seeking to exclude from the voting lists agents who just lost their jobs and have recall rights, as well as those still working for American Airlines during the voting process but who have plans to retire. And it's trying to pad the voting lists by adding nearly 900 workers. American Airlines has had a year to make its claims about changes to the lists, but doing it now, on the eve of the election, makes its true motive clear. American Airlines wants to throw another monkey wrench into the process, but agents are ready," said Sandy Rusher, CWA organizing director.

AA passenger service agents will have vote but it will be challenge. Attorneys for American Airlines are expected to appeal to the full Supreme Court, but they will need to get four of the nine justices to agree to hear the case, which is unlikely. Scalia is regarded as one of the most business-friendly justices. Even if the court decides to hear the case, it wouldn’t occur until some time in January, probably after the election has been held.

Well, if the company loses the union certification vote, I'm sure they will have G-2 double-down on their efforts to find people willing to work for those "competitive wages" with no benefits--that can also pass a security check. That way they can get rid of as many current gate agents as possible before the union process can get organized.
