So I guess what you're saying is that if the East had "won" the arbitration and the West was majorly unhappy y'all would've agreed to alter Nicolau's decision to appease us? As we say in Wisconsin, ya, you betcha!
 
The West has nothing to negotiate, they won, you lost.

The East is not in a positon of power to force the West to do anything.

Might as well stop with the rhetoric and get use to being in LGA the rest of your career.

This is the kind of rhetoric that won't get any of us anywhere. It has been more than a week now. Anger an frustration aside, we both need to find answers, soulutions, and a plan of attack to get this company back on track.

As stated earlier. Fences were offered. Your MEC thumbed their noses at fences and decided to put all of their eggs in the DOH/LOS basket.

The fences that are there are the only ones that you will ever see.

Not true. No such protection was offered. The AWA proposal fit on one page. Computers are a great tool Mr. Able.
 
I don't see any fences here, do you? Compare that to the
AAA ALPA offer to count spots and only allow bidding by each side for their respective spots first.

Spouting off about how much was offered just don't wash with the document trail. And we all know the worth of a verbal contract every time scheduling offers you a "favor."

America West Merger Committee Proposed Integration Methodology
December 14, 2006

1. Extract all pilots from both the AWA and AAA May 19, 2005 Certified Seniority List who:
a. Are currently on long term medical leaves of absence.
b. Are management, supervisory or check airmen who do not hold line-flying positions.
2. Integrate the number of AWA pilots equal to the number of AWA CA positions as of May 19, 2005 plus 114 additional positions that represent the pilots required to fill the CA positions that would have been attributable to the delivery of the remaining 19 A-320’s from the order for 22 A-320’s that would have been delivered to AWA had the merger not occurred (969 positions) with the number of AAA pilots equal to the number of AAA CA positions that would be attributable to a fleet consisting of 9 A-330, 10 B-767, 31 B-757, 69 B-737 and 92 A-320 aircraft (1121 positions) on a straight ratio basis, starting with the most senior AAA pilot followed by the most senior AWA pilot.
3. Integrate the remaining AWA pilots with the number of AAA pilots equal to the number of AAA FO positions that would be attributable to a fleet consisting of 9 A-330, 10 B-767, 31 B-757, 69 B-737 and 92 A-320 aircraft minus 228 positions (1051 positions) on a straight ratio basis, starting with the most senior AAA pilot followed by the AWA pilot.
4. Integrate the remaining AAA pilots (i.e. the number of AAA pilots on furlough as of May 19, 2005) following the pilots integrated pursuant to Paragraphs 2 and 3.
5. Reinsert all pilots extracted pursuant to Paragraph 1 into the integrated list immediately ahead of the next most junior pilot from the extracted pilot’s certified list.

So please tell us again, how will "getting this company BACK on TRACK" happen ?? :blink: :unsure:

So it's okay to refer to westies as "young punks" and to say that we are "stealing your seniority." I see.

Obviously you missed the point - wheather or not ALPA is still your bargaining agent has no bearing on your liability in a DFR suit. The east submitted to binding arbitration. They are bound by the decision even if ALPA is replaced. Should the east attempt to ignore the award the west will probably not even have to go to trial. The law is clear here and a summary judgement would be likely.

Unlike grievances punative damages are possible in this scenario. Should this happen you will have no choice about an assesment or to put it another way a wage garnishment.
PS: Ableoneable (is that one of 'dem fancy "I-Are-An Aviator" terms?...somehow I think that I'll not be crushed by the "dipwad", so there's no need to fret over any offence to myself or the East guys. Whether you perceive any point or not within my above posting's your issue. I think that it at least offers up some insight into the potential working enviornment you're so eager to make a move on.
Actualy it's just an easy to remember qwerty friendly word. It has no meaning at all.

The fact that you continue to insist that this award represents the west trying to steal from the east belies the fact that your understanding of the seniority system is deeply flawed.

I think you will see a big stink and the annual stockholders meeting in PHL with all the unions representing LCC make a media blitz stating "No Confidence"...
