Next week’s proceedings will be all about implementation of a perverted legal scheme to give the West Class representational status without an election. That's a given. I suggest the less exciting thread to follow in the trial will be this: Who wrote the language for the seniority section of the MOU? Who read it and approved it? What lawyers knew exactly what the language meant, when did they know? I don’t know the answers to these questions, but I have some pretty strong guesses. I contend everyone involved knew exactly what the language in the MOU meant. RR
I think you nailed it, it is obvious the PHX is in, since we weren't moved by her suggestions of letting some rouge group represent their own personal interests and negotiate against the recognized CB AGENT, she will offer some perverted advisory opinion, or ruling but I do not believe she will wait !

The defendants (america west pilots) and their co-conspirators have harassed and intimidated a pilot who was interested in becoming a USAPA representative by posting his telephone number on the AWAPPA website and suggesting that a “couple HUNDRED strongly worded [telephone] messages” may deter his participation with his union. The pilot has determined not to become a USAPA representative, thereby depriving Phoenix-based US Airways pilots of representation within USAPA’s political structure.

The pilot referenced in paragraph 85 was forced to seek the assistance of US Airways in dealing with multiple threats he received by both telephone and e-mail in response to his interest in becoming a USAPA representative. Upon information and belief, one such electronic communication sent by defendant Abbott on or about May 1
2008, inquired as to when a “blanket party” would be held for this pilot. Upon information and belief, a “blanket party” refers to a method of assault in which attackers restrain and blind their victim by throwing a blanket over the victim’s head, and then strike the victim repeatedly. The same pilot has been subjected to the threat of a concerted effort by multiple pilots to put him on a “no fly” list in order to severely limit or eliminate his work opportunities.
87. On or about May 9, 2008, a doll with “USAPA” written on it was discovered hanging from a noose inside the cockpit of a US Airways aircraft that landed at Lambert Airport in St. Louis, Missouri."

Would this be the Cactus 18 lawsuit which was dismissed? The one which the 4th Circuit threw a blanket on and smothered? That's the only blanket party I ever remember. :lol:

USAPA filed the suit, alleging violations of the RICO Statute, against certain pilots who were alleged to be engaged in an overt attempt to deny all US Airways pilots their right to collectively bargain by attempting to destroy our union and performing other harmful and destructive acts to disrupt the union’s ability to perform its representational responsibilities. The appeals court today affirmed the dismissal. Attorneys for the Association are reviewing the ruling presently for potential next steps."

That's comical coming from a Usapian(s) who have thrown a legit union off the property and replaced it with a rouge union.

Well...if you're just using courts' often bizarre and even sometimes magic little bubbling cauldrons to determine/validate your supposed morality; it's perhaps worth noting that O.J Simpson was brilliantly determined (apparently by a small colony of sea sponges) to be "not guilty". What's your point?...I mean besides: "Tee Hee, we got away with our childish, sick BS", of course? ;)

For myself; I've never much found the opinions of lawyers or judges (the latter still wearing black for an English king's death centuries ago) to be of any use when determining what my moral code should be. Your actual mileage may vary. :)

No worries. It's past difficult, and actually impossible to take, as a group, "you'se" mighty "spartans"/"knights"/etc at all seriously. ;)
I did try to do so far a good while, but simply can't anymore. Don't take that personally, since I'm fully aware that many of you west folks are sane and decent sorts that aren't perpetually stuck in puberty, and I don't know you, so...I'm left to judge the group from what I see and hear. Umm...I must ask though, if "clowns" are of the same class and craft as "spartans" or even "wizards" and "dire wolves", and is it really true that wearing an "Integrity Matters"/Ghost Shirt actually protects one against all moral failings? :)
